Member Liability definition

Member Liability. You are responsible for all transactions you authorize using your Visa Debit Card. If you permit someone else to use your card, you are responsible for any transactions they authorize or conduct on any of your accounts. You will not be held responsible for unauthorized transactions made with your Credit Union –issued Visa Debit Card if you exercise reasonable care in safeguarding the card from risk of loss or theft and, upon becoming aware, promptly report the loss or theft to the Credit Union. Under Regulation E, you could have up to $500 liability if the loss is not reported within two days of discovery. More Definitions of Member Liability

Member Liability. Members are responsible for all transactions they authorize using their EFT services under this EFT Policy. If a member permits someone else to use an EFT service, their card or their access code, they are responsible for any transactions they authorize or conduct on any of their accounts. A member must tell us immediately if they believe their card and/or access code has been lost or stolen or if they believe someone has used their card or access code or otherwise accessed their accounts without their permission, or if they believe that an electronic fund transfer has been made without their permission using information from your check. Right to Receive Documentation Periodic Statements: Transfers and withdrawals made through any debit card transaction will be recorded on the member’s periodic statement. Members will receive a statement monthly unless there is no transaction in a particular month. In any case, members will receive a statement at least quarterly. Terminal Receipt: Members can get a receipt at the time they make any transaction (except inquiries) involving their account using an ATM and/or point-of-sale (POS) terminal. Account Information Disclosure: Credit union personnel will disclose information to third parties about member accounts or the transfers they make: Business Days: Credit Union business days are Monday through Friday, excluding holidays.
Member Liability. The Member shall be liable to the Credit Union for and shall indemnify and hold harmless from any and all claims, causes of action, damages, expenses (including reasonable attorney's fees and other legal expenses), liabilities and other losses resulting from acts, omissions, or provision of invalid or inaccurate data by the member including without limitation; a) a breach by the Member of any provision of this agreement; b) the Credit Union debiting or crediting of the account of any person as requested by the Member; c) the failure to act or the delay by any financial institution other than the Credit Union. Any written notice to the Credit Union by the Member must be hand delivered to any branch during business hours or sent by U.S. mail or express carrier to the Corporate Office mailing address listed at the bottom of this agreement.
Member Liability. You are responsible for all transfers you authorize using EFT services under this Section II. If you permit other persons to use an EFT service, card, PIN, or access code, you are responsible for any transactions they authorize or conduct on any of your accounts. Fees: EFT service fees are set forth in our Fee Schedule. From time to time, we may charge fees at our sole discretion. We will notify you of any changes as required by law. If you use an ATM not operated by us, the ATM operator or ATM network you use may charge you a surcharge fee. The Credit Union will deduct the ATM surcharge from your account if you elect to complete the transaction. You may not use the card for any illegal or unlawful transactions, and we may decline to authorize any transaction that we believe poses an undue risk of illegality or unlawfulness. If you conduct a debit card transaction and you have opted in to Overdraft Protection, or you conduct any other EFT and overdraw your account, you agree to pay an Overdraft fee as set forth in the Fee Schedule. Member Liability. If a MasterCard cardholder does not report the unauthorized use promptly, the cardholder could have up to $500 liability if the loss is not reported within two days of discovery or unlimited liability of the unauthorized transaction if not reported within 60 days of when the unauthorized transaction was reported on a periodic statement.

  • Other Liabilities means any obligation on account of (a) any Cash Management Services furnished to any of the Loan Parties or any of their Subsidiaries and/or (b) any Bank Product furnished to any of the Loan Parties and/or any of their Subsidiaries.

Notwithstanding anything to the contrary contained in the foregoing or in any other provision of this Agreement or any Other Document, the foregoing is subject to the following provisos: (a) if a Swap Obligation arises under a master agreement governing more than one Swap, this definition shall apply only to the portion of such Swap Obligation that is attributable to Swaps for which such guaranty or security interest is or becomes illegal under the CEA, or any rule, regulations or order of the CFTC, solely as a result of the failure by such Borrower or Guarantor for any reason to qualify as an Eligible Contract Participant on the Eligibility Date for such Swap; (b) if a guarantee of a Swap Obligation would cause such obligation to be an Excluded Hedge Liability but the grant of a security interest would not cause such obligation to be an Excluded Hedge Liability, such Swap Obligation shall constitute an Excluded Hedge Liability for purposes of the guaranty but not for purposes of the grant of the security interest; and (c) if there is more than one Borrower or Guarantor executing this Agreement or the Other Documents and a Swap Obligation would be an Excluded Hedge Liability with respect to one or more of such Persons, but not all of them, the definition of Excluded Hedge Liability or Liabilities with respect to each such Person shall only be deemed applicable to (i) the particular Swap Obligations that constitute Excluded Hedge Liabilities with respect to such Person, and (ii) the particular Person with respect to which such Swap Obligations constitute Excluded Hedge Liabilities.
