Member State Law definition

Member State Law means any source of law of the Member State governing personal data processing which the Parties are subject to: in particular, Italian Legislative Decree no. 196/2003, "Personal data protection code", as amended and supplemented by Italian Legislative Decree no. 101/2018 of "Provisions for the adaptation of national legislation to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)";
Member State Law means all laws and regulations, including laws and regulations of the Republic of Serbia, European Union, the European Economic Area and their member states, Switzerland, the United Kingdom and the United States and its states, applicable to the Processing of Personal Data under this Clause as amended from time to time.

  • Any transfer of Personal Data to Third Countries by the Processor or sub-processor is strictly forbidden, unless the Processor has been instructed otherwise by the Controller, the transfer is required under EU or Member State Law or has otherwise been agreed upon between the Parties.

  • Process – and ensure that any person acting under its authority processes – Personal Data on behalf of the Controller and in compliance with its documented instructions, unless required to do so by Union or EU Member State Law to which the Processor is subject.

  • If, due to a Legal Provision, the Processor is prevented from processing the Data in accordance with this Contract and the instructions of the Controller, it shall inform the Controller of this before carrying out the processing, unless it is legally forbidden under Union or Member State Law to inform the Controller on important public interest grounds.

  • At the choice of the Controller, delete or return all the Personal Data to the Controller after the end of the provision of the services relating to the processing, and delete existing copies unless Union or Member State Law requires storage of the Personal Data.

  • Subject to mandatory statutory requirements under Union or Member State Law, the Processor shall only provide information to third parties, including supervisory authorities, with the prior consent of and in consultation with the Controller (in writing or by e-mail).

  • In such event, Processor shall, unless prohibited by such EU or Member State Law, inform Controller of that requirement before engaging in such Processing.

  • References in the Standard Contractual Clauses to GDPR, EU or Member State Law shall have the same meaning as the equivalent reference in Swiss Data Protection Laws.

  • In case of any transfers of Data from Switzerland, (a) general and specific references in the EU SCCs to GDPR or EU or Member State Law shall have the same meaning as the equivalent reference in the Swiss DPA, as applicable; and (b) any other obligation in the EU SCCs determined by the Member State in which the data exporter or Data Subject is established shall refer to an obligation under Swiss DPA, as applicable.

  • General and specific references in the Standard Contractual Clauses to GDPR, or EU or Member State Law, shall have the same meaning as the equivalent reference in Swiss Data Protection Laws, as applicable.

  • For Limited Transfer Regions other than the European Economic Area, references to the GDPR or EU or Member State Law will be replaced by references to Data Protection Laws of the respective Limited Transfer Region.
