You shall not acquire any Intellectual Property Rights in any Merchant Data Account, any Data, or Data Reports that we make available to you under this Contract.
Where My Business Dashboard is made available to you, the definition of Merchant Data Account in this Agreement shall include My Business Dashboard, such that the terms and conditions that apply to the Merchant Data Account shall apply equally to My Business Dashboard or such similar or replacement product made available to you from time to time, and any of our obligations in respect of the Merchant Data Account may be fulfilled by providing you with My Business Dashboard.
Except as expressly permitted under this Agreement, you must not copy, download, disclose or make available to any third party any Data from your Merchant Data Account or the Documentation in whole or in part.
Where My Business Dashboard is provided to you, the definition of Merchant Data Account in this Agreement shall include My Business Dashboard, such that the terms and conditions that apply to the Merchant Data Account shall apply equally to My Business Dashboard or such similar or replacement product provided to you from time to time, and any of our obligations in respect of the Merchant Data Account may be fulfilled by providing you with My Business Dashboard.
You should notify us immediately if you suspect that there may be or has been an unauthorised use of the Access Codes or of any other confidential material or information used in the provision of your Merchant Data Account.
We do not warrant that the Data available via your Merchant Data Account is accurate, up-to-date, reliable or error-free.
You are responsible for all losses resulting from any unauthorised activity in connection with your Merchant Data Account (including use of Access Codes and Terminals).
We will use reasonable endeavours to prevent unauthorised use of your Merchant Data Account upon receiving such notification.
In this Agreement, the following terms shall have the following meanings (unless the context otherwise requires): Access Code: each personal identification number and/or password that is necessary to enable you to access or use your Merchant Data Account and/or any Services.
The Data available via your Merchant Data Account is supplied to you on an “as is” basis for your information only.
