Merchant haulage definition

Merchant haulage means that the ocean carrier is responsible for delivering the cargo only to the destination container yard (“CY”), and the shipper is responsible for picking up and returning the empty container, as reflected in the bill of lading issued by the ocean carrier. Lars Jensen testified: “Basically means that the carrier is responsible for delivering the container to the container yard. Then it’s the responsibility of the shipper to arrange for the full container to [be] picked up at the terminal. And it’s the responsibility of the shipper to redeliver the empty container to a depot assigned or a number of depots assigned by the carrier within a given time frame.” APP 1087 (Jensen Tr. 363:15-364:4).
