Minimum Guaranteed Capacity definition

Minimum Guaranteed Capacity of the PV Plant means [ ] MW.
Minimum Guaranteed Capacity means the capacity of the Facility required to achieve the Commercial Operation Date as specified in the Key Information Table.
Minimum Guaranteed Capacity shall have the meaning set forth in Exhibit A-4.

Examples of Minimum Guaranteed Capacity in a sentence

  • The amounts payable under Clause 15 (Guaranteed Capacity and Performance Ratio) shall be the sole and exclusive financial remedies of the Project Company in respect of failure of the Facility to achieve the Minimum Guaranteed Capacity, the Contracted Capacity, the Guaranteed Performance Ratio and the Minimum Guaranteed Performance Ratio.

  • Failure to Achieve the Contracted Capacity If upon completion of the Initial Tests and any applicable Cure Period, other than due to a Relevant Event to which Clause 13 (Extensions of Time and Loss and Expense) or Clause 31 (Change in Law and Economic Stabilisation) applies, the Facility has failed to achieve the Contracted Capacity but achieves the Minimum Guaranteed Capacity, the Project Company shall be entitled to a reduction in the Price in accordance with this Clause 15.1(d).

  • Subject to Clause 15.2 (Failure to achieve the Minimum Guaranteed Capacity), such reduction shall be to the exclusion of any other financial remedy of the Project Company in respect of the failure to achieve the Contracted Capacity.

  • If: upon completion of the Initial Tests and any applicable Cure Period the Facility has failed to achieve the Contracted Capacity; or the Cure Period terminates prior to the completion of the Initial Tests, provided that the Minimum Guaranteed Capacity has been achieved, the Supplier and the Project Company shall calculate the reduction of the Price by reference to the formula set out in Schedule 13 (Price Reduction Formula).

  • The Capacity Test Certificate shall contain a statement whether (i) the Facility satisfies the Guaranteed Capacity, (ii) the Facility satisfies the Minimum Guaranteed Capacity, but not the Guaranteed Capacity, or (iii) the Facility fails to satisfy the Minimum Guaranteed Capacity.

  • Subject to the rights and remedies of Owner (including the rights and remedies arising from Section 22.2(f)), if the Facility fails to satisfy the Minimum Guaranteed Capacity, Contractor shall continue to perform in accordance with this Section until the Facility does satisfy the Minimum Guaranteed Capacity.

  • If the Capacity Test Report for the repeated Capacity Test indicates that the Facility satisfied the Minimum Guaranteed Capacity, but not the Guaranteed Capacity, then Contractor shall pay Owner the Capacity Performance Liquidated Damages as provided in Article 13 and Exhibit D.

  • The Improvements will be capable of generating a minimum of 150 megawatts (the “Minimum Guaranteed Capacity”); however, in the event that the Improvements have a Capacity (as defined herein) less than the Minimum Guaranteed Capacity, such circumstance shall not be a default under this Agreement so long as Owner pays the Annual PILOT Floor Amount specified in Section 2.3(b) of this Agreement.

  • If the Capacity Test Report indicates that the Facility failed to satisfy the Minimum Guaranteed Capacity or satisfied the Minimum Guaranteed Capacity, but not the Guaranteed Capacity, then Contractor shall promptly (and in any event within five (5) Business Days) submit to Owner for its review and approval a Remedial Plan and remedy such deficiencies in accordance with such Owner-approved Remedial Plan.

  • No later than three (3) Days after completion of the Capacity Test, Contractor shall execute and submit to Owner a report (“Capacity Test Report”) that includes the raw data and completed results of the Capacity Test, together with a comparison of such results to the Target Capacity, the Guaranteed Capacity and the Minimum Guaranteed Capacity (as each is defined in Exhibit A-4-1).

Related to Minimum Guaranteed Capacity

  • Contracted Capacity means the capacity (in MW AC) contracted with MSEDCL for supply by the successful bidder at the Delivery Point from the Solar Power Project.

  • Contract Capacity has the meaning set forth in Section 3.1(f).

  • Rated Capacity means the Average Daily Flow for which the Works are approved to handle;

  • Committed Capacity means that portion of the Capacity that is required to meet the Capacity Entitlements of Access Holders;

  • Installed Capacity or 'IC’ means the summation of the name plate capacities of all the units of the generating station or the capacity of the generating station (reckoned at the generator terminals), approved by the Commission from time to time;

  • Excess Capacity means volume or capacity in a duct, conduit, or support structure other than a utility pole or anchor which can be used, pursuant to the orders and regulations of the Commission, for a pole attachment.

  • Maximum Capacity or ‘Pmax’ means the maximum continuous active power which a power-generating module can produce, less any demand associated solely with facilitating the operation of that power-generating module and not fed into the network as specified in the connection agreement or as agreed between the relevant system operator and the power-generating facility owner;

  • Final RTO Unforced Capacity Obligation means the capacity obligation for the PJM Region, determined in accordance with RAA, Schedule 8. Financial Close:

  • Daily Unforced Capacity Obligation means the capacity obligation of a Load Serving Entity during the Delivery Year, determined in accordance with Reliability Assurance Agreement, Schedule 8, or, as to an FRR entity, in Reliability Assurance Agreement, Schedule 8.1. Day-ahead Congestion Price: “Day-ahead Congestion Price” shall mean the Congestion Price resulting from the Day-ahead Energy Market. Day-ahead Energy Market:

  • Project Capacity means the AC capacity of the project at the generating terminal(s) and to be contracted with MSEDCL for supply from the Solar Power Project.

  • Unforced Capacity shall have the meaning specified in the Reliability Assurance Agreement.

  • Potential electrical output capacity means, with regard to a unit, 33 per- cent of the maximum design heat input of the unit.

  • RA Capacity means the maximum megawatt amount that the CAISO recognizes from a Project that qualifies for Buyer’s Resource Adequacy Requirements and is associated with the Project’s Capacity Attributes.

  • Bid Capacity meanss capacity offered by the bidder in his Bid under invitation.

  • Reserved Capacity means the maximum amount of capacity and energy that the Transmission Provider agrees to transmit for the Transmission Customer over the Transmission Provider’s Transmission System between the Point(s) of Receipt and the Point(s) of Delivery under Tariff, Part II. Reserved Capacity shall be expressed in terms of whole megawatts on a sixty (60) minute interval (commencing on the clock hour) basis.

  • Licensed capacity means the number of children the Department has determined the day care home can care for at any one time in addition to any children living in the home who are under the age of 12 years. Children age 12 and over on the premises are not considered in determining licensed capacity.

  • Storage Capacity means any combination of space, injectability and deliverability.

  • System Capacity means the operational capacity of the System at any applicable point in time.

  • indemnified capacity means any and all past, present and future service by an indemnified representative in one or more capacities as a director, officer, employee or agent of the corporation, or, at the request of the corporation, as a director, officer, employee, agent, fiduciary or trustee of another corporation, partnership, joint venture, trust, employee benefit plan or other entity or enterprise;

  • Idle capacity means the unused capacity of partially used facilities. It is the difference between: (a) that which a facility could achieve under 100 percent operating time on a one-shift basis less operating interruptions resulting from time lost for repairs, setups, unsatisfactory materials, and other normal delays; and (b) the extent to which the facility was actually used to meet demands during the accounting period. A multi-shift basis should be used if it can be shown that this amount of usage would normally be expected for the type of facility involved.

  • New Capacity means a new Generator, a substantial addition to the capacity of an existing Generator, or the reactivation of all or a portion of a Generator that has been out of service for five years or more that commences commercial service after the effective date of this definition. For purposes of Section 23.4.5 of this Attachment H, “Offer Floor” for a Mitigated Capacity Zone Installed Capacity Supplier that is not a Special Case Resource shall mean the lesser of (i) a numerical value equal to 75% of the Mitigation Net CONE translated into a seasonally adjusted monthly UCAP value (“Mitigation Net CONE Offer Floor”), or (ii) the numerical value that is the first year value of the Unit Net CONE determined as specified in Section 23.4.5.7, translated into a seasonally adjusted monthly UCAP value using an appropriate class outage rate, (“Unit Net CONE Offer Floor”). The Offer Floor for a Mitigated Capacity Zone Installed Capacity Supplier that is a Special Case Resource shall mean a numerical value determined as specified in Section 23.4.5.7.5. The Offer Floor for Additional CRIS MW shall mean a numerical value determined as specified in Section 23.4.5.7.6. For the purposes of Section 23.4.5 of this Attachment H, “Non-Qualifying Entry Sponsors” shall mean a Transmission Owner, Public Power Entity, or any other entity with a Transmission District in the NYCA, or an agency or instrumentality of New York State or a political subdivision thereof.

  • Design capacity means the volume of a containment feature at a discharging facility that accommodates all permitted flows and meets all Aquifer Protection Permit conditions, including allowances for appropriate peaking and safety factors to ensure sustained, reliable operation.

  • Nominal Rated Capability means the nominal maximum rated capability in megawatts of a Transmission Interconnection Customer’s Customer Facility or the nominal increase in transmission capability in megawatts of the Transmission System resulting from the interconnection or addition of a Transmission Interconnection Customer’s Customer Facility, as determined in accordance with pertinent Applicable Standards and specified in the Interconnection Service Agreement.

  • Available RP Capacity Amount means the amount of Restricted Payments that may be made at the time of determination pursuant to Sections 6.04(a)(ii)(D), (a)(vii) and (a)(x) minus the aggregate amount of the Available RP Capacity Amount utilized by the Borrower or any Restricted Subsidiary to (a) make Investments pursuant to Section 6.06(q)(ii), (b) make Restricted Debt Payments pursuant to Section 6.04(b)(iv)(B) or (c) incur Indebtedness pursuant to Section 6.01(ll).

  • Nominal Capacity means the volume indicated by the manufacturer that represents the maximum recommended filling level.

  • Available Capacity means the capacity from the Project, expressed in whole megawatts, that is available to generate Product. [For As-Available Product facilities only]
