Module Components definition

Module Components means parts and components of the Fuel Cell Stack Module other than Fuel Cell Stack, necessary to assemble a Fuel Cell Stack Module, including but not limited to the catalytic oxidizer, mixer/eductor, stack enclosure vessel, enclosure insulation, flex hoses and instrumentation tubing.
Module Components. “Module component” means any sub-component of a memory module, other than a memory IC, insofar as this sub-component is developed by or on behalf of Qimonda and/or its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act and insofar as it is distributed by Qimonda or its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act exclusively in support of the functionality of a memory module. In other words, if such a sub-component is utilized or offered for purposes other than the exclusive support of the functionality of a memory module, then anyone undertaking such an activity may not rely upon the licenses granted by Infineon in Section 4. Qimonda embedded memory: “Qimonda Embedded Memory” is an embedded memory produced with manufacturing technologies and processes developed by or for Qimonda and/or its its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act. The manufacturing processes for complete semiconductor components containing Qimonda Embedded Memory also belong to Qimonda insofar as these processes were developed by or for Qimonda and/or its its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act; all other semi-conductor component-containing circuits that go beyond Embedded Memory are not included. Insofar as Qimonda Embedded Memory concerns embedded DRAM, the area of Stand Alone Memory also includes: (i) all other circuits that go beyond Embedded Memory, if these are developed by or for Qimonda and/or its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act, and (ii) such complete semiconductor components containing embedded DRAM as are distributed or under development by Qimonda and/or its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act on the Effective Date. Further, any Embedded Memory in computer readable form, e.g. VHDL Code, which was developed by or for Qimonda or its affiliated companies as defined in Sections 16 through 18 of the German Stock Corporation Act and which is distributed separately from semiconductors through licensing also belongs to Qimonda Embedded Memory. All other semiconductor components containing embedded memory, including embedded memory in computer readable form, e.g. VHDL code, do not belong to Qimonda Embedded Memory.
