The Expanded View of this advertising unit (a) promotes Music Products, ARTISTdirect Content or music related services available on the ARTISTdirect Network; (b) has a width no larger than 130 pixels and a variable height based on the number of characters used in accordance with subsection (d) below; (c) does not contain animation; and (d) contains headline text of no more than 18 characters, including spaces, and body text of no more than 200 characters, including spaces.

The Opening View of this advertising unit (a) promotes certain Music Products, certain ARTISTdirect Content or certain music related services available on the ARTISTdirect Network, as further promoted in the Expanded View of this advertising unit; (b) has dimensions no larger than 130 pixels wide by 40 pixels high; (c) does not contain animation; (d) may contain an image in GIF or JPG format; and (e) has a file size no greater than 3K.
Excite will not permit the display of advertising banners, promotional buttons, promotional links or other promotional materials for any retail sale of Music Products on the Excite Site, except those Music Products offered by Sponsor, nor advertising by any other Retail Music Store.
The DISTRIBUTORS shall use commercially reasonable efforts to distribute Music Products via the Internet by means of one or more websites controlled by the DISTRIBUTORS or its affiliates and/or licensees, at all times while this Agreement is in effect.

The DISTRIBUTORS shall have no right hereunder to modify the Music Products, except that it may employ audio-compression technology (including but not limited to MP3 at 128, 160, 192 and 256 Kbps, SHN, and FLAC) to encode the Music Products into digital audio files for the purpose of facilitating the exercise of the rights and licenses granted hereunder.
Client hereby grant to the DISTRIBUTORS, its licensees and assigns the non-exclusive right and license during the Term, throughout the Territory, on a royalty-free, gratis basis, to Stream the Music Products covered by this Agreement for purposes of promotion and publicity associated with the distribution and sale of Music Products.
In the event that average Base Rates for CD, audiocassette and vinyl Music Products increase by more than [***] during the term of this Agreement, CDnow may elect to terminate this Agreement upon 30 days written notice to Sound Delivery.
Notwithstanding the foregoing, Excite may make available opportunities on the Excite Site to purchase Music Products from parties other than Sponsor if such Music Products are not available from Sponsor so long as, prior to entering into arrangements to make available opportunities to purchase Music Products from parties other than Sponsor, Excite notifies Sponsor of its interest in the Music Products and gives Sponsor thirty (30) days to make the desired Music Products available through the Sponsor Site.
