Nationally Branded definition

Nationally Branded. (inclusive of internationally branded) means, as determined by the Director in his sole judgment, food and beverages, nationally or internationally recognized, sold by Concessionaire or Subcontractors where a royalty or franchise fee is charged by a franchisor and paid by Concessionaire or Subcontractor for the privilege of selling such food and beverages from the Facilities. Concessionaire, its Subcontractors, affiliates, parent, sister companies, and subsidiaries cannot be a franchisor for purposes of qualifying a particular food and beverage business as “nationally branded”.
Nationally Branded means concepts or products that are located geographically across the forty eight (48) contiguous U.S. states and/or participate in nationwide advertising, promotional, and/or marketing campaigns so that they are immediately recognized by a majority of the public.

  • However, absent reasonable cause, the Director will not disapprove of products that meet the specifications of the franchisors of Nationally Branded foods and beverages.
