Nationwide Settlement Class definition

Nationwide Settlement Class means all legally blind individuals in the United States who have attempted to access Target.com at any time from February 7, 2003 through the date of Final Approval of this Agreement and as a result have been denied access to the enjoyment of goods and services offered in Target stores.
Nationwide Settlement Class means all persons and entities of any kind who or which purchased and/or acquired a license in or for use in the United States (including its territories, possessions and commonwealths), other than for re-sale or re-licensing, for one or more Microsoft Operating Systems and/or Microsoft Applications, during the period January 1, 1985 through the date hereof, but excluding Microsoft, its officers, directors, successors, assigns and subsidiaries, and governmental entities.
Nationwide Settlement Class. All residents of the United States of America who have or had a loan serviced by Ocwen Financial Corporation or Ocwen Loan Servicing LLC (together, “Ocwen”) and who paid for one or more Broker Price Opinions (“BPOs”) or Hybrid Valuations (“Hybrids”) charged by Ocwen through Altisource, from November 5, 2010 through September 29, 2017, the date of the class certification order in this action.

  • Having made the finding set forth below, the Court conditionally certifies the following Nationwide Settlement Class and California Settlement Subclass (collectively, the “Settlement Class”) for settlement purposes only: The Nationwide Settlement Class: All natural persons residing in the United States whose Personal Information was exposed to an unauthorized party as a result of the Data Incident.

  • Notice shall be provided to the Nationwide Settlement Class and the California Settlement Class in the same manner as employed to provide class notice previously in this Lawsuit.

  • Only such objecting Nationwide Settlement Class Members and California Settlement Class Members shall have the right, and only if they expressly seek it in their objection, to present objections orally at the Fairness Hearing.

  • Target and Class Counsel shall ask the Court to order the following procedures for objections: Any Nationwide Settlement Class Member or California Settlement Class Member may object to the proposed Agreement by filing, within sixty (60) days after the Notice Deadline set by the Court, written objections with the Clerk of the Court with copies served on Class Counsel and Target.

  • Marketers in India are signing deals with celebrities in the hope of using celebrity power for their product positioning and repositioning in the consumer’s mind.

  • Additionally, the Executive Committee will draft the agenda for the General Body meetings, and perform any other functions as outlined in the By-laws.

  • For each occasion of ambulance or other emergency transportation service, add the nationwide base charge for the appropriate HCPCS code determined pursuant to paragraph (k)(2)(i) of this section to the product of the number of miles traveled and the appropriate HCPCS code mileage charge determined pursuant to paragraph (k)(2)(ii) of this section.

Related to Nationwide Settlement Class

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Classes means all Persons included in the Electrolytic Settlement Classes and the Film Settlement Classes.

  • Settlement Class Members means a Person(s) who falls within the definition of the Settlement Class.

  • Settlement Class Member means a member of a Settlement Class.

  • Settlement Class Counsel means the law firm of Xxxxxx Xxxxxx Xxxxx Xxxxxxx LLP.

  • Settlement Class Period means the period from and including January 1, 2000 through July 20, 2021.

  • Individual Settlement Payment means the amount payable from the Net

  • Settlement Cycle means the period of Clearance System Business Days following a transaction on the Relevant Exchange in the Underlying, during which period settlement will customarily take place according to the rules of such Relevant Exchange.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Gross Settlement Amount means $633,000.00 which is the total amount Defendant agrees to pay under the Settlement except as provided in Paragraph 9 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • ASX Settlement means ASX Settlement Pty Ltd (ABN 49 008 504 532);

  • First Class Mail When mailed first class to the last address of the recipient known to the party giving notice, notice is effective three (3) mail delivery days after deposit in a United States Postal Service office or mailbox. Certified Mail: When mailed certified mail, return receipt requested, notice is effective on receipt, if delivery is confirmed by a return receipt. Overnight Delivery: When delivered by overnight delivery (Federal Express/Airborne/United Parcel Service/DHL WorldWide Express) with charges prepaid or charged to the sender’s account, notice is effective on delivery, if delivery is confirmed by the delivery service. Facsimile transmission: When sent by facsimile to the facsimile number of the recipient known to the party giving notice, notice is effective on receipt, provided that, (a) a duplicate copy of the notice is promptly given by first-class or certified mail or by overnight delivery, or (b) the receiving party delivers a written confirmation of receipt. Any notice given facsimile shall be deemed received on the next business day if it is received after 5:00 p.m. (recipient’s time) or on a non-business day.
