Nationwide Settlement Class definition

Nationwide Settlement Class means all legally blind individuals in the United States who have attempted to access Target.com at any time from February 7, 2003 through the date of Final Approval of this Agreement and as a result have been denied access to the enjoyment of goods and services offered in Target stores.
Nationwide Settlement Class means all U.S. residents who, from September 5, 2013 to the date of the Preliminary Approval Order (as defined below), purchased prescription eyeglasses in the United States from LensCrafters after being fitted with AccuFit. Excluded from the Class are LensCrafters; LensCrafters’ employees, officers, and directors, as well as members of their immediate families; LensCrafters’ legal representatives, heirs, and successors; and any judge, justice, or judicial officer who have presided over this matter and the members of their immediate families and judicial staff.
Nationwide Settlement Class means all persons and entities of any kind who or which purchased and/or acquired a license in or for use in the United States (including its territories, possessions and commonwealths), other than for re-sale or re-licensing, for one or more Microsoft Operating Systems and/or Microsoft Applications, during the period January 1, 1985 through the date hereof, but excluding Microsoft, its officers, directors, successors, assigns and subsidiaries, and governmental entities.

  • Notice shall be provided to the Nationwide Settlement Class and the California Settlement Class in the same manner as employed to provide class notice previously in this Lawsuit.

  • However, prior to distributing participating Settlement Class Members’ pro-rata portions, the Class Administrator will first deduct from the Nationwide Settlement Fund: (i) all costs of class notice and settlement administration for the Class Members, as explained below in ¶ 10(F), and (ii) $1,000 for Plaintiff as incentive for his service to the Nationwide Settlement Class Members, as explained below in ¶ 10(C).

  • Nationwide Settlement Class and Microsoft agree that, under the circumstances, the best practicable means of notice to the Nationwide Settlement Class is notice by publication.

  • The Parties therefore agree not to assert in any context that the fact of this proposed settlement, or any stipulation to certification of the Nationwide Settlement Class, constitutes any concession or admission by Windsor that a litigation class could properly be certified.

  • It is expressly understood and agreed that this Settlement Agreement is being entered into solely for the purpose of amicably resolving all matters of any kind whatsoever between Microsoft and the Nationwide Settlement Class.

  • In the motion for conditional certification of the Nationwide Settlement Class and for preliminary approval of this Settlement Agreement (as set forth in Paragraph II.2 herein), Counsel for the Nationwide Settlement Class shall apply to the Court for an order authorizing summary notice by publication to the Nationwide Settlement Class substantially in the form to be agreed upon by Counsel for the Nationwide Settlement Class and Microsoft, and as approved by the Court.

  • This Settlement Agreement (with its appendices and expressly incorporated documents) contains the entire, complete and integrated statement of each and every term and provision agreed to by and among Counsel for the Nationwide Settlement Class and Microsoft, and is not subject to any condition not provided for herein.


More Definitions of Nationwide Settlement Class

Nationwide Settlement Class means all Accountholders who were assessed two OON Fees for a balance inquiry during the same visit at a FCTI ATM in the United States from May 1, 2018 to November 16, 2021. Excluded from the Nationwide Settlement Class are members of the New York Settlement Class, FCTI’s Counsel, Defendant’s officers and directors, and the judges presiding over the Actions.
Nationwide Settlement Class. All residents of the United States of America who have or had a loan serviced by Ocwen Financial Corporation or Ocwen Loan Servicing LLC (together, “Ocwen”) and who paid for one or more Broker Price Opinions (“BPOs”) or Hybrid Valuations (“Hybrids”) charged by Ocwen through Altisource, from November 5, 2010 through September 29, 2017, the date of the class certification order in this action.

Related to Nationwide Settlement Class

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Classes means the Ontario Settlement Class and the Quebec Settlement Class.

  • Settlement Class Members means any member of the Settlement Class.

  • Settlement Class Member means each person and entity who or which is a member of the Settlement Class.

  • Settlement Class Counsel means the law firm of Xxxxxx Xxxxxx Xxxxx Xxxxxxx LLP.

  • Settlement Class Period means the period from March 3, 2018 through February 10, 2022.

  • Individual Settlement Payment means the amount payable from the Net

  • Settlement Cycle means the period of Clearance System Business Days following a transaction on the Relevant Exchange in the Underlying, during which period settlement will customarily take place according to the rules of such Relevant Exchange.

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.

  • Structured settlement annuity means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injury suffered by the plaintiff or other claimant.

  • Viatical settlement provider means a person, other than a viator, who enters into or effectuates a viatical settlement contract. Viatical settlement provider does not include:

  • PJM Settlement or “PJM Settlement, Inc.” shall mean PJM Settlement, Inc. (or its successor), established by PJM as set forth in Section 3.3 of the Operating Agreement.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Structured settlement means an arrangement for periodic payment of damages for personal injuries established by settlement or judgment in resolution of a tort claim or for periodic payments in settlement of a workers’ compensation claim.

  • Purchase Contract Settlement Fund has the meaning specified in Section 5.5.

  • School setting means in the school, on school grounds, in school vehicles, at a designated bus stop or at any activity sponsored, supervised or sanctioned by the school.

  • Structured settlement agreement means the agreement, judgment, stipulation, or release embodying the terms of a structured settlement.

  • Energy Settlement Area means the bus or distribution of busses that represents the physical location of Network Load and by which the obligations of the Network Customer to PJM are settled.

  • Gross Settlement Amount means $240,000 which is the total amount Standard agrees to pay under the Settlement, except as provided in Paragraph 8 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.

  • ASX Settlement means ASX Settlement Pty Ltd (ABN 49 008 504 532);

  • Remarketing Settlement Date means the date of the settlement of any Successful Remarketing, which will be three Business Days after such Remarketing.

Any notice given facsimile shall be deemed received on the next business day if it is received after 5:00 p.m. (recipient’s time) or on a non-business day. Any party may change its address or facsimile number by giving the other party notice of the change in any manner permitted by this Agreement.

  • Class Prepayment Distribution Trigger For a Class of Subordinate Certificates for any Distribution Date, the Class Prepayment Distribution Trigger is satisfied if the fraction (expressed as a percentage), the numerator of which is the aggregate Current Principal Amount of such Class and each Class of Subordinate Certificates subordinate thereto, if any, and the denominator of which is the Scheduled Principal Balance of all of the Mortgage Loans as of the related Due Date, equals or exceeds such percentage calculated as of the Closing Date.
