NEA Plant definition

NEA Plant means Seller's cogeneration facility and all other associated equipment owned and operated by Seller and any additions or modifications and replacements thereto; (g) "Initial Supply Period" shall mean the period from January 1, 2003 through September 14, 2016. (h) "Relevant Agreements" shall mean the Operating Lease Agreement dated October 10, 2002 between Seller and BOC and the On-Site Steam Supply Agreement, dated October 10, 2002 between Seller and BOC. (i) "Three Party Agreement" shall mean the Three Party Agreement, dated October 10, 2002, among BOC, Buyer and Seller. (j) "Ton" shall mean 2,000 pounds ARTICLE II

  • PLANT DOWNTIME NEA shall promptly notify BOC of any NEA Plant downtime and the anticipated duration of such downtime.

  • In the event there is no Power, NEA shall arrange for backup power for the Facility at the same average cost as NEA obtains backup power for the NEA Plant including, but not limited to, energy charges, demand charges, transmission costs and distribution costs, less any applicable credits.

  • NEA herein specifically reserves for itself and/or any designee of NEA such utility and access easements over, under and across any and all areas or any parts of the Facility or the Facility Site, surrounding, adjacent to or contiguous with the building areas of the Facility, as the case may be from time to time required by NEA and/or its designee in connection with the use, ownership or operation of any part of the NEA Plant or any other premises operated by NEA or any of its Affiliates.
