Net Retail Price definition

Net Retail Price means, for each Early Window Title, the actual amount charged by Licensee (whether or not collected by Licensee) to a Subscriber on account of such Subscriber’s selection of such Early Window Title from the Licensed Service pursuant to a Subscriber Transaction, net of applicable sales tax, coupons, cash-back and/or other such marketing discounts in connection with such selection (excluding the Coupon), which Net Retail Price shall be determined by Licensee in Licensee’s sole discretion. Such Net Retail Price must be material and unaffected by the applicable Subscriber’s purchase of any other picture, product or service.
Net Retail Price means the price at which the distilled spirits is sold on retail in at least five (5) major supermarkets in Metro Manila, excluding the amount intended to cover the applicable excise tax and the value-added tax. For distilled spirits which are marketed outside Metro Manila, the ‘net retail price’ shall mean the price at which the distilled spirits is sold in at least five (5) major supermarkets in the region excluding the amount intended to cover the applicable excise tax and the value-added tax.
Net Retail Price means the price at which the cigar is sold in at least five (5) major supermarkets in the region excluding the amount intended to cover the applicable excise tax and the value-added tax. This shall be provided by the manufacturer or importer through a sworn statement and shall be validated by the Bureau of Internal Revenue (BIR) through a price survey.

More Definitions of Net Retail Price

Net Retail Price means the price at which the fermented liquor is sold on retail in at least five (5) major supermarkets in Metro Manila (for brands of fermented liquor marketed nationally), excluding the amount intended to cover the applicable excise tax and the value-added tax. For brands which are marketed outside Metro Manila, the ‘net retail price’ shall mean the price at which the fermented liquor is sold in at least five (5) major supermarkets in the region excluding the amount intended to cover the applicable excise tax and the value-added tax.
Net Retail Price means, in relation to the sale of any package or vessel of Beverage Alcohol, the amount obtained by subtracting the Retail Sales Tax and the Bottle Deposit from the Retail Price;

For avoidance of doubt, any consideration or royalties received from Sub-Licensee(s) are excluded. If a Licensed Product consists of components that are covered by valid claim of a Prospective Patent within the Invention (a “Covered Component”) and components that are not covered by a Valid Claim (“Other Components”), then Net Sales for such Licensed Products shall be multiplied by the fraction A/(A+B), where A is the value of the Covered Component(s) as reasonably determined by Licensee, and B is the value of the Other Component(s) as reasonably determined by Licensee, and such resulting amount shall be the “Net Sales Value” for purposes of the Royalties and Sub-License Royalties calculations in Clauses 5.1.2 and 5.3.1, respectively, for such Licensed Product.

  • Gross Sales Price with respect to each sale of Shares sold pursuant to this Agreement shall be the gross sales price per share of such Shares.
