No derogation definition

No derogation means no compromise of the right. See Black’s Law Dictionary, 10th ed. (“derogation” is the destruction of a right). No derogation is a higher standard of review than strict scrutiny. Unlike strict scrutiny, no derogation means that there is no balancing of interests between the individual and the state. Unless the government relies on another superseding jus cogens norm, no interest of government can possibly overcome an individual’s absolute right to refuse without negative consequences. The no derogation standard fits perfectly with the history of the Nuremberg Trials— for what governmental grounds could possibly have rationalized the heinous acts carried out by the Nazi doctors? Similarly, the no derogation standard of review is appropriate for the “mandates” that destroy citizens unless they are injected with experimental drugs.
