Non-Monetary definition

Non-Monetary. Defaults shall include, without limitation, a default under any Third Party Lease, the Leemilt's Lease, any Power Test Lease, the Gettymart Lease or under the provisions of a Fee Mortgage as a result of any action or failure to act by Tenant, Subtenant or their respective agents, contractors, employees, invitees or licensees in violation of the provisions of this Restated Lease.

  • The Non-Monetary Default Notice shall contain a statement that the Note B Holder’s or the Controlling Noteholder Representative’s failure to cure such Non-Monetary Default within the applicable Non-Monetary Default Cure Period after receiving such notice will result in the termination of the right to cure such Non-Monetary Default.

  • If there is a Non-Monetary Breach which is capable of being remedied the Landlord must not terminate this Lease without first giving formal notice to the Tenant and to each Creditor specifying the Non-Monetary Breach on which the Landlord is seeking to rely and specifying a date by which that Non-Monetary Breach must be remedied stating that failure to remedy the breach by that date may result in this Lease being terminated.

  • The Non-Monetary Default Notice shall contain a statement that the Curing Noteholders’ failure to cure such Non-Monetary Default within the applicable Non-Monetary Default Cure Period after receiving such notice will result in the termination of the right to cure such Non-Monetary Default.

  • If neither the Tenant nor any Creditor complies with a formal notice given under Clause 6.1.2(a) or if there is a Non-Monetary Breach which is not capable of being remedied the Landlord may: terminate this Lease with immediate effect by formal notice to the Tenant; and enter, repossess and enjoy the Premises as if this Lease had not been granted.

  • For the purposes of Clause 6.1.2(a): the date specified in any formal notice for remedy of a Non-Monetary Breach; and any measure to be taken by the Tenant specified in any formal notice, will be reasonable having regard to the nature and circumstances giving rise to the Non-Monetary Breach, the practicability of remedying it and the respective interests at that time of the Landlord, the Tenant and any Creditor under this Lease.

  • The period within which a Secured Lender may cure a particular Event of Monetary Default or Event of Non-Monetary Default shall not commence until the City has sent to the Secured Lender such copy of the applicable Notice of Breach or Hearing Notice.

  • If Developer causes either an Event of Monetary Default or an Event of Non-Monetary Default, then the City may commence proceedings to modify or terminate this Agreement pursuant to this Section 11.4.

  • The Non-Monetary Default Notice shall contain a statement in boldface font that the Controlling Noteholder’s or the Controlling Noteholder Representative’s failure to cure such Non-Monetary Default within the applicable Non-Monetary Default Cure Period after receiving such notice will result in the termination of the right to cure such Non-Monetary Default.

  • Except as provided in Section 12.1.2, neither entering into this Agreement nor a Breach of this Agreement, nor any Event of Monetary Default nor any Event of Non-Monetary Default shall defeat, render invalid, diminish, or impair the lien of any Mortgage made in good faith and for value.

  • The Non-Monetary Default Notice shall contain a statement that the Subordinate Noteholders’ or the Controlling Noteholder Representative’s failure to cure such Non-Monetary Default within the applicable Non-Monetary Default Cure Period after receiving such notice will result in the termination of the right to cure such Non-Monetary Default.

Related to Non-Monetary

  • Non-Monetary Default shall have the meaning assigned to such term in Section 11(d).

  • European Monetary System means the European Monetary System established by the Resolution of December 5, 1978 of the Council of the European Communities.

  • Non-Monetary Default Notice shall have the meaning assigned to such term in Section 11(d).

  • Retention Money means the accumulated retention moneys which the Procuring Entity retains under Sub-Clause

  • Failure to Pay means, after the expiration of any applicable Grace Period (after the satisfaction of any conditions precedent to the commencement of such Grace Period), the failure by a Reference Entity to make, when and where due, any payments in an aggregate amount of not less than the Payment Requirement under one or more Obligations, in accordance with the terms of such Obligations at the time of such failure.
