Non-Production Use definition

Non-Production Use means any use or installation of the Software for failover, disaster recovery, development, staging, technology integration, testing, and/or other such purposes, by GE Employees. GE shall not be subject to any requirement by ▇▇▇▇▇▇▇.▇▇▇ to pay fees for Support Services on a per use or installation basis, provided that there shall be a requirement that such fees shall be applicable to at least one instance of an Operational deployment in cases where a GE Business is undertaking any such Non-Production Use or installation of the Software and does not yet otherwise have an Operational deployment in place and GE seeks the benefit of Support Services.
Non-Production Use means any use or installation of the Software for failover, disaster recovery, development, staging, technology integration, testing, and/or other such purposes, whether by Customer or by Third Parties acting strictly on behalf of Customer. Customer shall not be subject to any requirement by Interwoven to pay Software Update or Technical Support Fees on a per use or installation basis, provided that there shall be a requirement that such Fees shall be applicable to at least one instance of an Operational deployment in cases where a Major Business Unit is undertaking any such Non-Production Use or installation of the Software and does not yet otherwise have an Operational deployment in place and Customer seeks the benefit of Software Updates and/or Technical Support Services. "Operational" shall mean, under the Enterprise License, for the Software installations, only those server installations of Software which are deployed for operational ("production") use in support of Customer. After December 31, 2000 and at Customer's option and request as set forth herein such Operational Software shall only be subject to annual Software Updates and/or Technical Support Fees under the Agreement, including Customer's right to change Technical Support Services upgrades to different Support levels or to change the number of Technical Contacts, as described on Schedule 1. "Software" shall mean a machine executable copy of the object code of the Interwoven Content Management software products, including all additional options and further including the related user manuals, documentation, and training materials, in either printed or electronic form, described on the attached Schedule 1 for the Software. "Software Update" shall mean a successor version of the given Software whether the successor version is characterized as a change in the one's, tenth's, hundredth's, or after hundredth's digit of the Software version number, or by such other means, and which successor version if generally available incorporates corrections, upgrades and/or enhancements to the Software, whether or not such corrections, upgrades and/or enhancements are marketed separately by Interwoven. Software Updates shall include, for example, migration from 32-bit Software to 64-bit Software, and migration from one platform generation to the next generation. Non-Production Use means internal use only by Customer and its employees for the benefit of Customer and not any third party or any affiliate of Customer on a Non-Production Development System, Test System, Hot Standby System, or Cold Standby System.

Examples of Non-Production Use in a sentence

  • For purposes of the calculation of any Fees based upon installations of copies of the Software, all Non-Production Use Copies of Software shall be disregarded.

  • Unless specified in such documentation applicable to such Non-Production Services, you shall not use Non-Production Use Services in a way that involves Personal Data in the Customer Data or in a way that would pose risk to you if the relevant Non-Production Services failed in any respect.

  • Any Data produced from Non-Production Use of the Product and/or Service or provided to OneSpan during the Non- Production Use is not recoverable or available upon the expiration or termination of the aforementioned Non-Production Use period.

  • For greater certainty, the license to use the Software granted under this Agreement includes both Production Use and Non-Production Use, subject to payment of the applicable license fees, if any, as set forth in the applicable License Order.

  • If you have purchased a Royalty Free License, you are hereby permitted to redistribute, into perpetuity, without further payment of royalties, the Software only as part of a Derivative Work, in object form only, on an unlimited number of Instances internally and externally to your organization, for both Production Use and Non-Production Use, as permitted under the terms of this SLSA.

  • Royalty Free Support includes email and/or support portal-based assistance for named individuals with issues relating to affecting a Royalty Free License in either Production Use and Non-Production Use, including diagnosing, reviewing and troubleshooting code.

  • Any Data produced from Non-Production Use of the Product and/or Service or provided to OneSpan during the Non-Production Use is not recoverable or available upon the expiration or termination of the aforementioned Non-Production Use period.

ABC shall not be subject to any requirement by ▇▇▇.▇▇▇ to pay fees for Support Services on a per use or installation basis, provided that there shall be a requirement that such fees shall be applicable to at least one instance of an Operational deployment in cases where a ABC Business is undertaking any such Non-Production Use or installation of the Software and does not yet otherwise have an Operational deployment in place and ABC seeks the benefit of Support Services.
Non-Production Use means internal use only of Non-Production Licensed Software by Customer and its employees for the benefit of Customer (and not for the benefit of any third party or any affiliate of Customer) on a Non-Production Development System, Non-Production Test System, Hot Standby System, or Cold Standby System.
Non-Production Use means non-operational use of the Software (including, without limitation, development, testing, training, and fail-over purposes) for, or in support of, the Business Purposes.
