The term “Refugee' refers to any person of Central African nationality or whose former usual residence was in the Central African Republic, and who has the status of refugee in Cameroon, as defined by the Convention of 28 July 1951 relating to the status of refugees and its Additional Protocol of 31 January 1967 as well as the OAU Convention of 10 September 1969 governing Specific Aspects of Problems of Refugee in Africa.
Rwanda is party to the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa and ratified the 2009 African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (the Kampala Convention) in 2012.
The first ones, “refugees”, face situations recognized under the 1951 Convention relating to the Status of Refugees and its 1967 Protocol, the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa; those recognized in accordance with the UNHCR Statute; individuals granted complementary forms of protection; or, those enjoying "temporary protection" (UNHCR, 2013).
It is a non-derogable norm of customary international law, since the prohibition is expressed in many international or regional legislative instruments246 and reflects 246 Article 6 ICCPR, article 2 (3) of the 1969 OAU Convention Governing Specific aspects of refugee Protection in Africa.
