Except as expressly provided or modified in this First Amendment, the terms and provisions of the Original Loan Agreement shall remain unchanged and in full force and effect and are hereby affirmed, confirmed and ratified in all respects.

Further, the Borrower represents and warrants that it is not in default under the Original Loan Agreement or any Borrower Document, and no event of default which with the passage of time or the giving of notice would constitute a default under the Original Loan Agreement or Borrower Documents.
The Borrower represents and warrants that the representations of the Borrower contained in Section 2.03 of the Original Loan Agreement are true and correct as of the date hereof and the Borrower has not breached any of its covenants contained in Section 2.03 of the Original Loan Agreement.
