Original Security Instrument definition

Original Security Instrument means, collectively, (i) the Tax-Exempt Mortgage, Security Agreement and Fixture Financing Statement, dated as of the Series 2021 Delivery Date, by the Borrower, granting a first priority mortgage and security interest in the Project to the Governmental Lender to secure the repayment of the Series 2021 Project Loan and related obligations, and (ii) the Tax-Exempt Assignment of Leases and Rents, dated as of the Series 2021 Delivery Date, by the Borrower to the Governmental Lender which Security Instrument was assigned by the Governmental Lender to the Initial Funding Lender pursuant to the Assignment of Mortgage and Project Loan Documents, dated as of the Series 2021 Delivery Date, by the Governmental Lender to the Initial Funding Lender as security for the Series 2021 Funding Loan.
Original Security Instrument is defined in the Recitals of this Continuing Covenant Agreement.
Original Security Instrument shall have the meaning set forth in the recitals of this Modification Agreement.

Examples of Original Security Instrument in a sentence

  • The execution of this Agreement by Hotel Owner and Hotel Operator shall be deemed its execution of the Original Note, the Original Security Instrument and the other Original Loan Documents.

  • Neither this Instrument nor the Note extinguishes the indebtedness of the Original Note or discharges or releases or in any way adversely affects the lien or lien priorities of the Original Security Instrument or any other security for the indebtedness of the Original Note.
