Orphan Pipeline Fund definition

Orphan Pipeline Fund means a not-for-profit organization to be established pursuant to a statute of the Parliament of Canada whose purpose includes paying for the cost to Abandon a pipeline constructed or operated under a statute of the Parliament of Canada;

Orphan Pipeline Fund means a not-for-profit organization tocorporation that will be established pursuant to a statute of the Parliament of Canada whose purpose includes paying for the cost to Abandon a pipeline constructed or operated under a statute of the Parliament of Canadaand will maintain funds for the purpose of funding reclamation of abandoned pipelines in Canada, consistent with the NEB’s Reasons for Decision

Orphan Pipeline Fund means a not-for-profit organization to bethat will be established pursuant to a statute of the Parliament of Canada and will maintain funds for the purposes of funding the reclamation of abandoned pipelines in Canada consistent with the NEB’s reasons for Decision MH-001-2013whose purpose includes paying for the cost to Abandon a pipeline constructed or operated under a statute of the Parliament of Canada;

• If property remains in the Fund after all Reclamation Obligations of the Beneficiaries are discharged, then the Trustee, with the approval of the Tribunal, may distribute the Fund or any part thereof among any of the Beneficiaries and Orphan Pipeline Fund, or, where such is the case, a single Beneficiary and the said Orphan Pipeline Fund, as the Trustee in its sole discretion sees fit.

• If Property remains in the Trust Fund after all Reclamation Obligations are discharged, then the Trustee, with the approval of the NEBCER, may distribute the Trust Fund or any part thereof among any of the Beneficiaries, including the Orphan Pipeline Fund, or, where such is the case, a single Beneficiary and the said Orphan Pipeline Fund as the Trustee in its sole discretion sees fit.

• If Trust is terminated pursuant to Section 13.2 and Property remains in the Fund after all Reclamation Obligations of the Beneficiaries has been completed and paid for, then the Trustee, with the approval of the NEB, may distribute the Fund or any part thereof among any of the Beneficiaries and if applicable, the Orphan Pipeline Fund, or, where such is the case, a single Beneficiary and the said Orphan Pipeline Fund, selected by the Trustee as the Trustee in its sole discretion sees fit.

• If property remains in the Fund after all Reclamation Obligations of the Company with respect to the Site are discharged, then the Trustee, with the approval of the Tribunal, shall distribute the Fund among some one or more of the Company and Orphan Pipeline Fund, and in such proportions, as the Trustee in its absolute discretion determines.

• If property remains in the Fund after all Reclamation Obligations of the Beneficiaries are discharged as finally determined by the Tribunal, then the Trustee, with the approval of the Tribunal, may distribute the Fund or any part thereof among any of the Beneficiaries and the Orphan Pipeline Fund as the Trustee in its sole discretion sees fit, or, where such is the case, a single Beneficiary and the Orphan Pipeline Fund.

• If Property remains in the Trust Fund after all Reclamation Obligations are discharged, then the Trustee, with the approval of the NEB, may distribute the Trust Fund or any part thereof among any of the Beneficiaries, including thean Orphan Pipeline Fund, or, where such is the case, a single Beneficiary and the said Orphan Pipeline Fund as the Trustee in its sole discretion sees fit.
