Orphan Pipeline Fund definition

Orphan Pipeline Fund means a not-for-profit organization to be established pursuant to a statute of the Parliament of Canada whose purpose includes paying for the cost to Abandon a pipeline constructed or operated under a statute of the Parliament of Canada;
Orphan Pipeline Fund means a not-for-profit organization established pursuant to a statute of the Parliament of Canada the purpose of which includes paying any part of the cost to Abandon, Deactivate, and Decommission a pipeline constructed or operated under a statute of the Parliament of Canada. Person: includes a partnership. Pipeline: shall have the meaning ascribed thereto in Appendix A hereof.
Orphan Pipeline Fund means a not-for-profit organization to bethat will be established pursuant to a statute of the Parliament of Canada and will maintain funds for the purposes of funding the reclamation of abandoned pipelines in Canada consistent with the NEB’s reasons for Decision MH-001-2013whose purpose includes paying for the cost to Abandon a pipeline constructed or operated under a statute of the Parliament of Canada;

  • If property remains in the Fund after all Reclamation Obligations of the Beneficiaries are discharged, then the Trustee, with the approval of the Tribunal, may distribute the Fund or any part thereof among any of the Beneficiaries and Orphan Pipeline Fund, or, where such is the case, a single Beneficiary and the said Orphan Pipeline Fund, as the Trustee in its sole discretion sees fit.

  • In summary, Cochin and Trans Mountain propose the following modifications to the NEB's approved version of the PRT Agreement:  Sections 1.1 "Beneficiary" and 13.2.6 – Given the definition of "Orphan Pipeline Fund" (i.e., "…a not-for-profit organization established pursuant to a statute of the Parliament of Canada…"), the definition of "Beneficiary" in section 1.1 has been amended to refer to "an" Orphan Pipeline Fund, rather than "the" Orphan Pipeline Fund.

  • If property remains in the Fund after all Reclamation Obligations of the Company with respect to the Site are discharged, then the Trustee, with the approval of the Tribunal, shall distribute the Fund among some one or more of the Company and Orphan Pipeline Fund, and in such proportions, as the Trustee in its absolute discretion determines.
