The supply of propellant in the Marina must be carried out in accordance with the provisions of this Regulation, the Code of Conduct and the applicable Regulations on Handling of Hazardous Substances, Conditions and Manner of Transport in Maritime Traffic, Loading and Unloading of Dangerous Substances, Bulk and Other Cargo in Ports and Manner of Preventing the Spreading of Spilled Oils in Ports.
However, in order to optimise the use of the facility and as per the provisions of this agreement and in case the Concessionaire handles Other Cargo as directed by the Concessioning Authority, for some other User during the Operation phase, the Concessioning Authority shall be entitled to levy and recover tariff from the Owners/ consignees of cargo and the vessel owners/ agents using the Project Facilities and Services as per the Scale of Rates notified time to time.
Further, the Concessionaire shall collect the Cargo handling Charges at the rates approved by the TAMP for handling Other Cargo through the mechanized facility as set out in Appendix 12 and applicable from time to time and shall pay to the Concessioning Authority 25% of the same as Royalty.
The Major Stockholder agrees not to grant any proxies (except pursuant to Section 1.1(f) of this Agreement) or to enter into any agreement (other than this Agreement) with respect to the voting of shares of EAST Common Stock held by him that are inconsistent with or in conflict with the intent of this Agreement.
