Other damage claims of DISTRIBUTOR shall become time-barred two years after the date on which DISTRIBUTOR obtains, or without the presence of gross negligence would have obtained, knowledge of the facts giving rise to the claim and of the identity of the person or entity causing the damage or loss, however no later than three years after the time of the event causing the damage.
