Other Patents means patents and/or patent applications owned and/or controlled by THIRD PARTIES having claims which would be infringed by SB making, having made, using, having used, selling or having sold PRODUCT.

More Definitions of Other Patents

Other Patents means all Patent Rights, other than the Licensed Patents, that are Controlled by TNK or Sorrento as of the Effective Date and/or during the term of this Agreement and which would be infringed by the making, having made, using, selling, or importing of Licensed Products in the Field in the Territory.

Other Patents means each and every unexpired patent right of J&J issued or pending as of July 1, 1987, other than C-C Patents and Diaper Patents, including patents which result from the issuance, re-examination, reissue, extension or foreign equivalent of such patent or patent application.

For clarity, Other Patents shall include: (i) all Patents filed after the Effective Date which claim priority to any of the foregoing Patents, to the extent they cover subject matter disclosed and/or claimed in the foregoing Patents; and (ii) any patent(s), other than the ▇▇▇▇▇▇▇▇ Patent Rights, issuing anywhere in the world from any application (including, but not limited to, divisionals, continuations, continuations-in-part and renewals) that (1) is pending on or after the Effective Date and (2) claims priority (directly or indirectly) to the application from which U.S. Patent No. 6,685,941 issued or any application to which U.S. Patent No. 6,685,941 claims priority, wherein the manufacture, use, sale, offer for sale, exportation and/or importation of any Licensed CTLA4 Product would infringe an issued claim or claims thereof.
