There are no material latent or patent defects in the physical condition of the Real Property and the Improvements, except for defects, which, individually or in the aggregate, would not have a material adverse effect on the Owned Interest or the Leasehold Interest, or with the value, use, or occupancy of the Real Property or Improvements.
