Parent and child relationship" means the legal relationship existing between a child and the child's natural or adoptive parents incident to which the law confers or imposes rights, privileges, duties, and obligations.
Parent and child relationship created by operation of law This issue has arisen in the context of section 12 of HAMA,56 which many Immigration Appeal Board decisions interpreted as having the effect of creating a parent and child relationship by operation of law.57 In Sharma,58 the Federal Court – Trial Division indicated that[a] parent and child relationship is not automatically established once the requirements of a foreign adoption have been demonstrated.
