Notwithstanding the provisions hereof, the Developer must convene the first AGM within 60 (Sixty) days of the transfer of 60% (Sixty) of the Land Units arising from the subdivision of the Parent Property or within a period of 2 (two) Years of the transfer of the first Land Units, whichever is the earlier.
The Purchaser hereby undertakes that he will, at all times, co-operate with the Developer or its successor-in-title or nominee, in an endeavour to facilitate the success of the development of the Parent Property.
The Developer will, during the Development Period, be entitled to apply and obtain approval for the amendment of the rezoning or subdivision approval of the Parent Property or any Land Unit without the consent of the Association, any Sub-Association, any Body Corporate or Owner/Member or Occupant.
The Developer, during the Development Period, or the Association, Sub-Association, Body Corporate and all service providers as approved by the Board or the Developer, during the Development Period, will at all times have free and unencumbered access to all registered servitudes, as referred to in Governing Rule18.3 below, affecting the Parent Property or any Land Unit.
The Association is constituted as a legal persona in terms of Chapter 6 Part 5 of the MPBL in accordance with the conditions imposed by the Developer and the Local Authority, when approving the development rights pertaining to the Parent Property .
