Parties to the proceeding definition

Parties to the proceeding means the complainant, respondent, necessary parties and persons permitted to intervene as parties in a proceeding with respect to a complaint filed under this chapter.

Examples of Parties to the proceeding in a sentence

  • The award rendered by a majority of the arbitrators appointed pursuant to this Agreement, including an award that quantifies and requires a Party to pay its proportionate contribution under Article 11 of this Agreement pursuant to an approved budget of the Board and lawful appropriations made by the Party, shall be final and binding on all Parties to the proceeding, and the Parties agree to be bound by such award.

  • An award rendered by a majority of the arbitrators appointed under and pursuant to this Agreement shall be final and binding on all Parties to the proceeding during the period of this Agreement or thereafter to the extent that the Agreement has covenants which survive the Agreement.

  • Each Party shall ensure that, in any such tribunals or procedures, the Parties to the proceeding are provided withthe right to: (a) a reasonable opportunity to support or defend their respective positions;and (b) a decisionbased onthe evidenceand submissionsofrecord or, where required by domestic law, the record compiled bythe administrative authority.

  • In any proceeding with respect hereto, all direct, reasonable costs and expenses (including, without limitation, AAA administration fees and arbitrator fees) incurred by the Parties to the proceeding shall, at the conclusion of the proceeding, be paid by the Parties incurring same.
