• Payor Class Members who submit a substantially accurate and valid claim shall be entitled to receive a refund of one-half of the amount of ETF they actually paid to EarthLink.

• Medi-Span stipulates to certification of the Private Payor Class as defined in Paragraph 1 for settlement purposes only, and for the sole purpose of creating that settlement class.
