Performance Apparel definition

Performance Apparel means all apparel that has unique construction (e.g., compression gear) or fabrications (e.g., moisture-wicking) that assist the wearer during sport, exercise or general athletic tasks in all types of weather, but excluding heavy outerwear and rainwear. In order to constitute “Performance Apparel,” the special characteristics must also be marketed as a feature of the product through hangtags, jock tags, or other labels on the product.
