Plan Classes definition

Plan Classes. The Plan divides all Claims and Interests into 14 different Classes. Each Claim will receive the same treatment as all other Claims in the same Class under the Plan, so that the applicable terms of the Plan for each Claim depend upon its classification.

Examples of Plan Classes in a sentence

• Under the Plan, Classes 1, 4, 5, 7, 8 and 14 are Unimpaired; therefore, the holders of Claims and Interests in such Classes are conclusively presumed to have accepted the Plan pursuant to section 1126(f) of the Bankruptcy Code.

• Under the Plan, Classes 1, 2, 3, 5, and 11 are Unimpaired; therefore, the holders of Claims and Interests in such Classes are conclusively presumed to have accepted the Plan pursuant to section 1126(f) of the Bankruptcy Code.

• BY EBS EBS will provide personal services to shareholders and beneficial owners of Advisors Preferred Class, Preferred Class and Select Class (the "Plan Classes") shares of each Series of Principal Investors Fund, Inc.

• Presumed Acceptance of the Plan Classes 2, 3, 5 and 6 are Unimpaired by the Plan and are conclusively presumed to have accepted the Plan pursuant to section 1126(f) of the Bankruptcy Code.

• Because holders of Class 6 Claims and Class 7 Interests are not entitled to receive or retain any property under the Plan, Classes 6 and 7 are presumed to have rejected the Plan and, therefore, are not entitled to vote on the Plan.

• The Classes of Claims and Interests that are Impaired that are receiving no distribution under the Plan (Classes A7, A8, A9, B7, and B8) shall not be entitled to vote to accept or reject the Plan and shall be conclusively presumed to have rejected the Plan.

• Under the Plan, Classes 1, 4, 5, 6, 7, 8, 13 and 14 are Unimpaired; therefore, the holders of Claims and Interests in such Classes are conclusively presumed to have accepted the Plan pursuant to section 1126(f) of the Bankruptcy Code.
