Buyer acknowledges that all Vessels shall be required to comply with all applicable Load Port Procedures and that Seller shall not be liable for any costs, expenses or damages that may arise as a result of any Vessel or Owner failing to comply with such procedures.
In the event Customer’s Vessel fails to vacate its berth at the Terminal upon Completion of Loading or as otherwise required under the Marine Provisions and/or under the Port Procedures (as applicable), unless such failure is caused solely by Enterprise, Customer will pay Enterprise an additional dockage fee equal to $7,000 per hour for each hour (or part thereof) that such Vessel so remains at its berth at the Terminal (the “Excess Occupancy Payment”).
Enterprise reserves the right to approve or reject Customer’s nominated Vessel(s) in advance in accordance with the Marine Provisions, the Port Procedures, and Enterprise’s then-current Vessel requirements.
In no event shall the total amount paid to Contractor exceed the Contract Price unless the Contract amount has been increased by one or more change orders signed by the City.
Notices required under the Marine Provisions or the Port Procedures shall be sent or transmitted as specified therein.
Enterprise reserves the right to amend, supplement, modify or otherwise change the Port Procedures, from time to time, in its sole discretion, and will provide written notice to Customer reflecting changes in such rules, regulations, policies and procedures.
Current applicable Port Rules and Regulations, Port Procedures and Directives, and Port Tariffs may be obtained by Concessionaire(s) from the Port’s Ground Transportation Office located at the Airport.
Concessionaire(s) is granted a vehicle permitpermits allowing Concessionaire(s)’s Independent Contractors to operate vehicles to pick-up and deliver passengers at the Airport in accordance with these Operating Instructions, applicable Port tariffs, Port Rules and Regulations, and Port Procedures and Directives pertaining to operation of vehicles; City of Seattle, King County or other applicable regulatory agency statutes, ordinances, and regulations and any or all amendments to the foregoing.
