  • Buyer acknowledges that all Vessels shall be required to comply with all applicable Load Port Procedures and that Seller shall not be liable for any costs, expenses or damages that may arise as a result of any Vessel or Owner failing to comply with such procedures.

  • In the event Customer’s Vessel fails to vacate its berth at the Terminal upon Completion of Loading or as otherwise required under the Marine Provisions and/or under the Port Procedures (as applicable), unless such failure is caused solely by Enterprise, Customer will pay Enterprise an additional dockage fee equal to $7,000 per hour for each hour (or part thereof) that such Vessel so remains at its berth at the Terminal (the “Excess Occupancy Payment”).
