Private Labeler definition

Private Labeler means an owner or licensee of a brand or trademark on the label of a consumer product which bears a private label; provided, however, that Settling Defendant is not a Private Labeler due solely to the fact that its name, brand or trademark is visible on a sign or on the price tag of a Fashion Accessory that is not labeled with a third party’s brand or trademark.
