The Standard. (a) Employees are entitled to annual leave in accordance with the provisions of the Standard (refer to Division 4 of Part 7 of the Act).
(b) Casual employees have no entitlement to annual leave.
The Standard. (a) Employees are entitled to parental leave in accordance with the provisions of the Standard (refer to Division 6 of Part 7 of the Act).
(b) Casual employees have no entitlement to parental leave unless they are eligible casual employees.
(c) Parental leave comprises maternity leave, paternity leave and adoption leave.
The Standard. No representation or warranty of Xxxxxxx contained in ARTICLE 5 shall be deemed untrue or incorrect, and Xxxxxxx shall not be deemed to have breached a representation or warranty, in each case for all purposes hereunder, including the condition set forth in Section 8.3(a), as a consequence or result of the existence or absence of any fact, circumstance, change or event unless such fact, circumstance, change or event, individually or taken together with all other facts, circumstances, changes or events inconsistent with any representation or warranty contained in ARTICLE 5 has had or is reasonably likely to have a Material Adverse Effect on Xxxxxxx (it being understood that for the purpose of determining the accuracy of such representations and warranties, other than the representation in Section 5.7, all “Material Adverse Effect” qualifications and other materiality qualifications contained in such representations and warranties shall be disregarded); provided, that the foregoing shall not apply to the representations in Sections 5.2 (first sentence only), 5.3(a), 5.3(b)(i), 5.4(b) and 5.15, which shall be true and correct in all material respects, and the representations and warranties in Sections 5.4(a), 5.4(c) and 5.7, which shall be true and correct in all respects (except for inaccuracies in Sections 5.4(a) and 5.4(c) that are de minimis in amount).
The Standard. No representation or warranty of Target contained in Article 4 shall be deemed untrue or incorrect, and Target shall not be deemed to have breached a representation or warranty, in any case as a consequence or result of the existence or absence of any fact, circumstance, change or event unless such fact, circumstance, change or event, individually or taken together with all other facts, circumstances, changes or events inconsistent with any representation or warranty contained in Article 4 has had or is reasonably likely to have a Material Adverse Effect on Target (it being understood that for the purpose of determining the accuracy of such representations and warranties, other than the representation in Section 4.8, all “Material Adverse Effect” qualifications and other materiality qualifications contained in such representations and warranties shall be disregarded); provided, that the foregoing shall not apply to the representations in Sections 4.2(i), 4.3(a), 4.3(b)(i), and 4.21, which shall be true and correct in all material respects and the representations and warranties in Sections 4.4(a), 4.4(c), 4.7(iv) and 4.8, which shall be true and correct in all respects (except for inaccuracies in Sections 4.4(a) and 4.4(c) that are de minimis in amount).
The Standard. (a) Employees are entitled to personal leave in accordance with the provisions of the Standard.
(b) Casual employees have no entitlement to paid personal/carer’s leave, but do have an entitlement to unpaid carer’s leave.
The Standard. 7.1 The Operator shall use the Standard for the purposes of assessment and certification.
7.2 The Operator shall seek written agreement from the Authority to make any material change to the Standard.
The Standard. No representation or warranty of WSFS contained in Article 5 shall be deemed untrue or incorrect, and WSFS shall not be deemed to have breached a representation or warranty, in any case as a consequence or result of the existence or absence of any fact, circumstance, change or event unless such fact, circumstance, change or event, individually or taken together with all other facts, circumstances, changes or events inconsistent with any representation or warranty contained in Article 5 has had or is reasonably likely to have a Material Adverse Effect on WSFS.
The Standard. 1. The first step of the computations is to determine elemental elapsed times by subtracting successive watch readings. These times are to be recorded in column marked "Individual."
2. Before taking up the summary of the elapsed times, the study should be carefully examined for abnormal values. If any are found, they should be indicated so that they can be readily distinguished and excluded from the summary. No time shall be excluded unless it is noted on the study. No watch readings shall be struck out in the taking of a time study unless a clear explanation of the reason for the exclusion appears on the observation sheet. Strikeouts which are decided upon after the Time Study Observer has left the department will be shown on the Time Study Summary Sheet with the high strikeouts summarized and the low strikeouts summarized and the two totals listed separately. Should there be a dispute as to the number of strikeouts, only those values which are more than one standard deviation above or below the mean may be eliminated.
3. After elimination of abnormal values, the elapsed time for occurrence of each element is added and the average determined. The full decimal, to four (4) places, should be shown in this average.
4. The Standard i) Employees are entitled to annual leave in accordance with the provisions of the Standard (refer to Division 4 of Part 7 of the Act). In effect:
a) Full time ordinary workers – no more than 4 weeks per anniversary year
b) Shift workers – In addition to the four weeks, one additional week at the conclusion of each anniversary year, or alternately, additional annual leave in accordance with the Counter Leave provisions of this Agreement, whichever is more generous.
c) Part time employees are entitled to a pro rata accrual of entitlement
d) Casual employees have no entitlement to annual leave.
The Standard. No representation or warranty of BCB contained in Article 5 shall be deemed untrue or incorrect, and BCB shall not be deemed to have breached a representation or warranty, in any case as a consequence or result of the existence or absence of any fact, circumstance, change or event unless such fact, circumstance, change or event, individually or taken together with all other facts, circumstances, changes or events inconsistent with any representation or warranty contained in Article 5 has had or is reasonably likely to have a Material Adverse Effect on BCB.
