private organisation definition

private organisation means an individual, body corporate, partnership, trust, unincorporated association or body other than an exempt organisation or small business operator. Small business operators (those business operators who have an annual turnover of less than $3,000,000 and who are not health service providers) are not included within the definition of “private organisation” so as not to impose an undue burden on them. The effect is that a small business that is not a health service provider, for instance a hairdresser or sporting organisation, will not be required to comply with the HPPs. However, all health service providers, including small businesses such as medical practitioners and others who provide a health service, must comply with the HPPs. This approach reflects that adopted in the Privacy Act 1988 (Cth);
private organisation means the privately-owned organisation established under the Civil and Commercial Code or under specific laws of which not less than one-half of all members are the small or medium enterprise operating in industries, services or trading, and shall include other private organisations prescribed by the Minister by publishing in the Government Gazette;
