Product Issue definition

Product Issue means specific MarketSafe CDs designed by EverBank with unique design features, which may be subject to change from issue to issue, such as Reference Index(es), Product Term, Participation Factor, Reference Index value determination, Interest, Market Upside Payment, and/or other features unique to that Product Issue.
Product Issue means a failure of a Program to perform properly including a failure of a Program to function in accordance with the Documentation;
Product Issue means, with respect to V2 Products covered by this Agreement: (1) any issue relating to a potential safety hazard or unsafe condition caused by or associated with such product, (2) any issue related to the quality of the products, including, but not limited to, manufacturing or design defects that may impact the quality of the products, labeling, packaging, declared net contents ingredients, or formula, or (3) advisement of an issue or condition stipulated by any governmental authority having jurisdiction over such products.

Examples of Product Issue in a sentence

  • Supplier agrees to be the primary contact with any government agency if Acuity Brands requests it to do so, and will be responsible for applicable filings, however, Supplier and Acuity Brands shall consult with one another prior to making any statements to the public or to any governmental agency concerning the Product Issue, except in circumstances in which doing so would prevent timely notification that may be required to be given under applicable law.

  • The parties shall cooperate in communication with the public and governmental agencies and in correcting any such Product Issue that is found to exist.

  • If a Safe Product Issue presents a substantial risk of personal injury, death or damage external to the HP Branded Product, unless affected units are recalled, HP shall have the right to require a recall of affected units in addition to the right to compel the shipment hold.

  • Expenses associated with the correction of a Product Issue shall be solely Supplier’s responsibility, including the actual cost of the Goods, as well as the costs of inspection, investigation, replacement, retrieval, storage, transportation, destruction and/or disposal, notification to customers and governmental agencies, record- keeping, and other administration, internal management timeand attorneys’ fees.

  • If the dispute is not resolved within twenty (20) days of being so referred, the parties may institute legal proceedings except that the Disputed Product Issue referenced in Section 2.2 shall first be resolved using arbitration as provided for in that Section 2.2 using the procedures outlined in this Section 11.

  • Aerosol Product means a pressurized spray system that dispenses product ingredients by means of a propellant contained in a product or a product's container, or by means of a mechanically induced force. “Aerosol Product” does not include “Pump Spray.”

  • Drug sample means a unit of a prescription drug that is not intended to be sold and is intended to promote the sale of the drug.

  • Finished Product means a cannabis product in its final form to be sold at a retail premises.

  • Reference biological product means the single biological product licensed pursuant to 42 U.S.C.

  • Hemp product means the same as that term is defined in § 3.2-4112.

  • Licensed Product means a product or part of a product in the Licensed Field of Use: (A) the making, using, importing or selling of which, absent this license, infringes, induces infringement, or contributes to infringement of a Licensed Patent; or (B) which is made with, uses or incorporates any Technology.

  • Generic Version means, with respect to a Licensed Product, a product (including a “biogeneric,” “follow-on biologic,” “follow-on biological medicine or product,” “follow-on protein product,” “similar biological medicine or product,” or “biosimilar product”) that: (a) within the U.S., is “biosimilar” or “interchangeable,” with respect to such Licensed Product as evaluated by the FDA or otherwise determined by Applicable Law; or (b) in the ROW, is determined by the applicable Regulatory Authority or by Applicable Law to be “similar,” “comparable,” “interchangeable,” “bioequivalent,” or “biosimilar” to such Licensed Product. For clarity, a Biosimilar of a Licensed Product shall constitute a Generic Version of such Licensed Product.

  • Licensed Compound means [***].

  • Drug Substance means an active ingredient that is intended to furnish pharmacological activity or other direct effect in the diagnosis, cure, mitigation, treatment, or prevention of disease or to affect the structure or any function of the human body, but does not include intermediates used in the synthesis of such ingredient.

  • Product Candidate means any pharmaceutical product developed, manufactured and/or tested by or on behalf of the Company that has not received a Regulatory Authorization for commercial distribution other than in connection with pre-clinical or clinical trials.

  • Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

  • Other Product means Product which an End User acquired from sources other than Integrator.

  • Biological product means a virus, therapeutic serum, toxin, antitoxin, vaccine, blood, blood component or derivative, allergenic product, protein other than a chemically synthesized polypeptide, or analogous product, or arsphenamine or any derivative of arsphenamine or any other trivalent organic arsenic compound, applicable to the prevention, treatment, or cure of a disease or condition of human beings.

  • New Products means any product which is not an Enhanced Product or 2 Existing Product but which is substantially similar to an Existing Product with respect to design and function and possesses reasonable performance improvements. If Company desires to purchase an Enhanced or New Product(s) from Supplier, Company shall so notify Supplier and provide Supplier the opportunity to manufacture such Enhanced or New Product(s), subject to the following conditions and procedures.

  • Red Hat Products means Software, Services, Subscriptions and other Red Hat branded offerings made available by Red Hat.

  • Replacement Product means electric generating capacity, capacity-related benefits, environmental attributes, Energy or other electric products from a generation resource other than the Facility that are provided or delivered to replace or substitute for Contract Capacity or Storage Capacity (or any Capacity-Related Benefit, Environmental Attribute, Other Electric Product, Contract Energy, or Storage Energy associated therewith), in each case, in whole or in part, pursuant to Section 4.6.

  • Approved Product means any water fitting, plumbing product, material or component which is the subject of an existing WRAS Approval;

  • Edible cannabis product means cannabis product that is intended to be used, in whole or in part, for human consumption, including, but not limited to, chewing gum, but excluding products set forth in Division 15 (commencing with Section 32501) of the Food and Agricultural Code. An edible cannabis product is not considered food, as defined by Section 109935 of the Health and Safety Code, or a drug, as defined by Section 109925 of the Health and Safety Code.
