Product Issue definition

Product Issue means specific MarketSafe CDs designed by EverBank with unique design features, which may be subject to change from issue to issue, such as Reference Index(es), Product Term, Participation Factor, Reference Index value determination, Interest, Market Upside Payment, and/or other features unique to that Product Issue.
Product Issue means a failure of a Program to perform properly including a failure of a Program to function in accordance with the Documentation;
Product Issue means, with respect to V2 Products covered by this Agreement: (1) any issue relating to a potential safety hazard or unsafe condition caused by or associated with such product, (2) any issue related to the quality of the products, including, but not limited to, manufacturing or design defects that may impact the quality of the products, labeling, packaging, declared net contents ingredients, or formula, or (3) advisement of an issue or condition stipulated by any governmental authority having jurisdiction over such products.

  • For the avoidance of doubt LICENSEE shall be responsible for costs and expenses iincluding, but not limited to, those resulting from actions required due to a Safe Product Issue, Legal Product Issue, and/or Critical Quality Issue.

  • Generic Product means a drug product that (i) contains the same active ingredient as the Product where the Product is the reference-listed drug, and (ii) is approved by a Governmental Authority pursuant to an Abbreviated New Drug Application, an application under 21 U.S.C. §355(b)(2), or similar application.

  • Pharmaceutical Product shall have the meaning ascribed to such term in Section 3.1(hh).

  • Drug sample means a unit of a prescription drug that is not intended to be sold and is intended to promote the sale of the drug.

  • Licensed Product means a product, method or service in the Licensed Field of Use, the making, having made, using, importing or selling of which, absent this license, infringes, induces infringement, or contributes to infringement of a Licensed Patent.
