PUC Order definition

PUC Order has the meaning set forth in Section 4.01(h).
PUC Order. The order of the PUC, dated March 18, 2004, authorizing each PPL Electric Party to enter this Agreement and each other Transaction Document.

  • For the avoidance of doubt, Company has no obligation to seek reconsideration, appeal, or other administrative or judicial review of any Unfavorable PUC Order.

  • The term "Unfavorable PUC Order" means an order from the PUC concerning this Agreement that: (i) dismisses Company's application; (ii) denies Company's application; or (iii) approves Company's application but contains terms and conditions deemed unacceptable by Company in its sole discretion and therefore does not meet the definition of a PUC Approval Order as set forth in Section 29.20(a) (PUC Approval Order).

  • As such, except as provided by PUC Order No. 07-098, the parties will not knowingly provide VNXX service in Oregon or knowingly aid the other party in providing VNXX service in Oregon.

  • Notwithstanding references to VNXX traffic in this section, the parties recognize that the Oregon PUC currently prohibits VNXX arrangements except as provided by PUC Order No. 07-098.

  • Promptly after issuance of the PUC Order, HECO shall provide to AES Hawaii a copy of the PUC Order and written confirmation of whether the PUC Order meets the requirements of the preceding sentence.

  • Use the proceeds of the Advances hereunder solely for the Borrower’s general corporate purposes (including supporting commercial paper issued by the Borrower) and in compliance with the Minnesota PUC Order, and not to (x) finance any Hostile Acquisition or (y) purchase or carry any Margin Stock in violation of Federal Reserve Board Regulations T, U or X.

  • HECO shall endeavor to obtain such PUC Order in a form meeting the requirements of this paragraph by June 17, 2003, or such later date as the Parties may agree to as provided in paragraph 4 of this Amendment No. 2, but HECO shall not have any liability if such PUC Order is not obtained for any reason.

  • No authorization, consent or approval from any Governmental Authority is required for the execution, delivery and performance by the Borrower of this Agreement, the Revolving Notes and the other Loan Documents to which it is a party, except such authorizations, consents and approvals, including, without limitation, the PUC Order, as have been obtained prior to the Closing Date and are in full force and effect.
