As of the date of this Agreement MidPen Housing Corporation has been so designated and approved to develop the Developable Affordable Parcels, subject to the possible designation of an alternative Qualified Housing Developer as may be necessary or appropriate.

The Regulatory Agreement will be recorded on the Developable Affordable Parcel at the time of conveyance to the Qualified Housing Developer.
