Qualifying timber definition

Qualifying timber means those forest trees for which the small forestland owner is willing to grant the state a forestry riparian easement and meets all of the following:
Qualifying timber means Timber which meets or exceeds the specifications set forth in Schedule 1.29 to this Agreement.
Qualifying timber means those trees covered by a forest practices application that the small forest landowner is required to leave unharvested under rules adopted under RCW 76.09.055 or 76.09.370 or that are made uneconomic to harvest by those rules, and for which the small forest land- owner is willing to grant the state a forestry riparian ease- ment. Qualifying timber is timber within or bordering a com- mercially reasonable harvest unit, or timber for which an approved forest practices application for timber harvest can- not be obtained because of restrictions under these rules. Qualifying timber is categorized as follows:

Examples of Qualifying timber in a sentence

  • Subject to the terms and conditions of this Agreement, Seller agrees to sell and Buyer agrees to purchase for each Harvesting Year during the Term of this Agreement all Qualifying Timber harvested from the Actual Designated Tracts (as hereinafter defined).

  • Promptly after harvest all Qualifying Timber shall be weighed at the Mill or at one of Buyer’s remote woodyards.

  • Promptly after harvest all Qualifying Timber shall be weighed (or, with respect to sawtimber, ) at the Mill, Piketon Merchandising Yard, or other outside location as determined by Buyer.

  • Owner and Buyer may also by mutual agreement contract for the purchase and sale of timber other than Qualifying Timber on terms that are identical to or different from those applicable to Qualifying Timber sales under this Agreement.

  • Buyer shall harvest (i.e., cut and remove) within 12 months (or such other period provided under a Cutting Contract) in accordance with each Cutting Contract, all Qualifying Timber designated for cutting by Owner in said Cutting Contract, subject to a Force Majeure event.
