Tenant shall not damage or destroy the Remediation Equipment, and to the extent that Tenant does damage or destroy such Remediation Equipment, Tenant shall promptly upon receipt of an invoice from Landlord, pay to Landlord, all actual, third-party costs, fees and expenses incurred by Landlord to repair or replace such Remediation Equipment.

Accordingly, the possibility exists that the MEW Responsible Parties and EPA may require access to the Project to install modifications of, or enhancements to, the Remediation Equipment (as defined below) and access to the Premises to implement the OM&M Plan, provided that any access into the Building shall comply with the provisions of Article 27 of this Lease and Section 29.19.4(x) below.
Alternatively, at City’s request, Tenant may remove Remediation Equipment from the occupied portions of the Premises at Tenant’s sole cost and expense, provided the removal of such Remediation Equipment will not hinder any Corrective Action or violate any law.
