Remediation Systems definition

Remediation Systems shall have the meaning set forth in Section 5.5.
Remediation Systems are any and all structures, machinery, equipment, walls, wells, piping, motors, covers, vaults, filters, extraction devices, biological mechanisms, and other non-naturally occurring devices, and organisms now or hereafter existing, installed or otherwise used on or about the Premises for the remediation, removal, investigation, monitoring, or other response to the Pre-Existing Environmental Condition, including without limitation any and all electrical, water, gas, and other utility services required for the operation of any of the foregoing.
Remediation Systems means that or those certain machinery, equipment and fixtures used in connection with the Environmental Action, including without limitation, treatment sheds, monitoring wells, monitoring devices, vapor extraction systems, pump and treat systems, air sparge and compressor systems, bioremediation systems, oil and water separators and associated personal property and fixtures.

Examples of Remediation Systems in a sentence

  • Varex agrees to pay all the costs associated with any request it makes to move or redesign installed Remediation Systems.

  • Varex agrees that it will not disrupt or alter any Remediation Systems without prior written consent of Parent and the applicable Government Authorities, which consent by Parent shall not be unreasonably withheld.

  • Parent shall retain ownership and control over Remediation Systems.

  • Parent agrees to install and operate future Remediation Systems in a manner that reasonably minimizes conflicts with Varex’s use of the Varex Real Property, and shall consult with Varex prior to, and Varex shall have the right to approve, which approval shall not be unreasonably withheld, conditioned or delayed, such future installation and operation.

  • Subject to the terms of any applicable Ancillary Agreement or Commercial Agreement, Varex agrees to allow for the installation and operation, in each case on the Varex Real Property, of any Remediation Systems determined by Parent to be necessary or advisable, without payment of rent or fees.

  • Varex acknowledges and agrees that certain remediation equipment and fixtures (e.g., monitoring ▇▇▇▇▇, soil vapor extraction and groundwater treatment systems) used in the Remedial Activities (“Remediation Systems”) will be present on the Varex Real Property as of the Effective Time, and Remediation Systems may be installed on Varex Real Property following the Effective Time.

  • LMC, acting through Sector or other Subsidiaries, shall perform, control and directly pursue the processing of radioactive and mixed waste at Hanford, Washington, in connection with the performance of the existing Tanked Waste Remediation Systems -- Privatization Cont▇▇▇▇ ▇▇-▇▇▇▇-▇▇▇▇▇▇▇▇▇ ▇▇▇ future extensions or modifications to, or enhancements or replacements of, such contract(s) (collectively, the "Tanked Waste Contract").

  • The resolution of any potential liabilities for Prospective Purchasers, in exchange for carrying out the activities contemplated by the Cleanup and Abatement Order No. 93-082, the RWQCB-approved Final Design Report, Groundwater Remediation Systems, and WDRs accompanying this PPA with respect to the Existing Contamination by GWRC, confers on the RWQCB a substantial benefit which is fair, reasonable and in the public interest.

  • The foregoing shall not impose any obligation on Lessee with respect to the Remediation Systems.

  • Lessee acknowledges that such Remediation Systems are owned by third parties who have the right to maintain such Remediation Systems on the Property pursuant to the access agreements described in Exhibit “C” attached hereto (the “Access Agreements”), and Lessee’s rights in and to the Property after Closing will be subject to such third party rights.

Remediation Systems means the chromium- and perchlorate- related ground water intercept and treatment systems and equipment, utility lines servicing only such intercept systems and equipment, and any other ongoing environmental contamination investigation, treatment or remediation systems or equipment.
