The WTCPUA Required Facilities are described in Exhibit B and shall be constructed by WTCPUA or other third parties.
Developer shall reserve for and convey fee simple title to the WTCPUA a subdivision utility lot at a location and size acceptable to the WTCPUA for WTCPUA’s construction, ownership and operation of the WTCPUA Required Facilities.
Along with the Developer Facilities, construction and completion of the Required Facilities is necessary for the commencement of service by WTCPUA to the Proposed Development.
TU Electric shall evaluate, design, install, control, own, operate and maintain all Required Facilities and perform all work, at TU Electric's expense, necessary to reliably and safely connect the Delivery Point to the rest of the TU Electric System in order to accept and meter the energy and capacity to be transmitted hereunder.

If events beyond our control prevent the Cathedral or any of the Required Facilities being made available to you (including without limitation extreme weather, power outages or earthquakes), you agree that we have no liability for any costs or loss incurred or suffered by you as a result.
