Restricted Access Information definition

Restricted Access Information means Subject Data generated by [Navy Collaborator] that would be Proprietary Information if the Information had been obtained from a non-Federal Collaborator participating in a CRADA (15 USC 3710a). Under 15 USC 3710a(c)(7)(B), the Collaborators mutually may agree to provide appropriate protection to Subject Data generated by [Navy Collaborator] (Restricted Access Information) against public dissemination or release under the Freedom of Information Act (FOIA) for a period of up to five (5) years after development of the Information.
Restricted Access Information means Subject Data generated by NMRC that would be Proprietary Information if the Information had been obtained from a non-Federal Collaborator participating in a CRADA (15 USC 3710a). Under 15 USC 3710a(c)(7)(B), the Collaborators mutually may agree to provide appropriate protection to Subject Data generated by NMRC (Restricted Access Information) against public dissemination or release under the Freedom of Information Act (FOIA) for a period of up to five (5) years after development of the Information.
Restricted Access Information means Confidential Information within the meaning of paragraph 1(b) that is designated by a Disputing Party as restricted access on the grounds that:

Examples of Restricted Access Information in a sentence

  • The Collaborators agree to confer and consult prior to any publication or public disclosure of Subject Data to ensure that no Proprietary Information, Restricted Access Information, Government Classified Information, CUI, or MCT Information is released and that patent rights are not compromised.

  • Restricted Access Information shall be protected from public dissemination for up to five (5) years, as mutually agreed.

  • If a Collaborator objects to the release of Information on the grounds that the Information is Proprietary Information, Restricted Access Information, or Information whose dissemination is restricted by U.S. security laws or regulations, the disclosure shall be postponed until the Information no longer meets the definitions of Proprietary Information, Restricted Access Information, or is no longer covered by U.S. security laws or regulations.

  • Collaborator shall request in writing if it wishes Subject Data generated by ARL to be marked as Restricted Access Information.

  • NRL shall inform XYZ whenever Subject Data generated by NRL is to be marked as Restricted Access Information.

  • Notwithstanding the foregoing, for all purposes, [NAVY COLLABORATOR] shall treat Subject Data it generates as Restricted Access Information.

  • XYZ shall request in writing if it wishes Subject Data generated by NRL to be marked as Restricted Access Information.

  • Restricted Access Information will be marked in a manner similar to the following: "RESTRICTED ACCESS INFORMATION - TREAT AS PROPRIETARY TO IMPLANT SCIENCES CORPORATION." NRL will review all such designated Proprietary and Restricted Access Information and, in consultation with ISC, will determine whether it qualifies as "Proprietary or Restricted Access Information" in accordance with the criteria of Articles 4.12 and 4.13.

  • Notwithstanding the above provision, (a) all BIOPURE Information embodied in FDA communications to NMRC shall be protected as Proprietary Information or Restricted Access Information regardless of whether such information is properly marked as such and (b) all Biopure Information embodied in FDA communications to NMRC that is Information in intangible form shall constitute Proprietary Information to which the requirements of the third and fourth sentences of this Section 7.1.1.4 shall not apply.

  • All Restricted Access Information may be exempt from release under the Freedom of Information Act for a period of five (5) years as provided for at 15 U.S.C. § 3710a(c)(7)(B).


More Definitions of Restricted Access Information

Restricted Access Information means Subject Data generated by the Government that would be Proprietary Information if the information had been obtained from a non-Federal collaborator participating in a CRADA. PROVIDER and RECIPIENT will designate all RESTRICTED ACCESS INFORMATION.
Restricted Access Information means Confidential Information within the meaning of paragraph 1(b) that is designated by a Disputing Party as restricted access on the grounds that the wider disclosure of the information in question to those otherwise permitted to see Confidential Information would give rise to a real risk of material prejudice to the Disputing Party to whom that information relates.

The term, “confidential,” as used throughout this Agreement, refers to the customary definition and should not be confused with the level of classification for national security information. Restricted Access Information does not include information which is generally known or is available from another source without obligations concerning its confidentiality, or is described in an issued patent, published patent application, or published copyrighted work.
