Retrospective Approval definition

Retrospective Approval means approval by Irish Water of Variance Costs in accordance with Clause 36.2.5 after those Variance Costs have been actually incurred by the Local Authority;

  • Retrospective Approval or no Approval will be unacceptable and will constitute a material and irremediable breach of this Agreement.

  • Retrospective Approval shall be made by Irish Water where there are material expenditures outside Budget that have been incurred by the Local Authority where Local Authority management were confronted with a situation that required rapid decision-making and responsiveness by the Local Authority without time for prior approval by Irish Water, including, without limitation, emergency situations involving issues of public health, environmental protection or safety.
