Sale Monies definition

Sale Monies means the monies from the sale of the Delivery Parcel obtained by the Issuer (or its nominee) on behalf of the Investor under the Agency Sale Option, less Break Costs and if applicable Delivery Costs, including brokerage, applicable to the sale of the Delivery Parcel;

Examples of Sale Monies in a sentence

  • We may ask you for an initial payment of Margin upon entry into the Forward FX Contract and a final balance payment for the remainder of the Sale Monies prior to the Value Date of the Forward FX Contract (please see clause 2 for more details).

  • You will be deemed to direct the Issuer to direct the Custodian (or its nominee) to hold the Delivery Parcel on your behalf and to authorise and direct the Issuer (or its nominees) to sell or procure the sale of the Delivery Parcel and to apply the resulting Sale Monies (which includes a deduction for any Delivery Costs) to pay the Lender an amount equal to the outstanding Loan Amount as at the time the Acceptor assumed your obligations under the Loan, and any surplus will be paid to you.

  • If you wish to use the Agency Sale Option and receive Sale Monies (which includes a deduction for any Delivery Costs), you need to make this election in the Notice of Maturity.

  • This is because the Sale Monies belong to the Investor and the Issuer cannot grant a Security Interest over this amount.

  • There is a risk that the Custodian may be unable to perform its obligations under the Custody Deed and that Investors may not receive the Sale Monies, Delivery Assets or other amounts or assets due to them when due under the Terms.

  • The Issuer believes this risk is remote however a delay in delivering the Delivery Parcel and/or Sale Monies could occur.

  • Investors should note that the Secured Property does not include the Sale Monies if an Investor elects the Agency Sale Option.

  • On the Maturity Date, the Issuer will sell the Portion of the Delivery Assets and the Sale Monies from this sale will be included in the Final Value.
