Examples of Selected Brands in a sentence

  • HDD shall have the right to identify up to three alternative wine brands from the HDD Brands to replace the initial Selected Brands (provided that Precept shall continuously market at least three or more HDD Brands through 2028).

  • In addition to the financial information set forth in Section 2 above, Precept will provide to HDD, in writing on an annual basis, a full accounting showing how any amounts due to HDD for the preceding Annual Reporting Period have been calculated as provided in this Agreement, including an accounting of Net Revenue and Gross Profit for the Selected Brands with a reporting of any applicable and permitted Cost of Goods Sold, deductions, allowances, and charges.

  • Precept agrees to use commercially reasonable efforts to promote, market and sell the Products under the Selected Brands during each Annual Royalty Period.

  • The total number of Selected Brands shall not exceed three wine brands during any Annual Royalty Period.

  • Constant Retail hereby grants to the Client, during the Term, a worldwide, non-transferable, non-sub licensable, fully paid license to use the Hosted Site solely for the purposes of operating the Client’s e-commerce business of selling to Customers products related to the Selected Brands.

  • Each Annual Royalty Period Precept shall pay HDD an Annual Royalty Payment based on Precept’s sales of wine, beverages or other products sold under the Selected Brands (collectively “Products”) under the following three HDD Brands: Cense, Curious Beasts, Colby Red (the “Selected Brands”), which were initially selected by HDD and are subject to adjustment pursuant to Section 2 herein.

  • Except for such services pursuant to either Section 2.1 or Section 2.2 above as may have been elected for by the Client, the Client shall otherwise be responsible in all respects for all advertising, promotion and marketing of the Hosted Site, the Merchandise for sale on the Hosted Site and the Selected Brands available on the Hosted Site, as well as costs thereof (which costs shall not, for the avoidance of doubt, be deemed to reduce Net Sales Revenue).

  • Such pro rata portion shall be based on Precept’s Gross Profit from the sale of Products under the Selected Brands during such quarterly period.

  • During each Annual Royalty Period, Precept will provide financial information on a quarterly basis relating to sales of the Selected Brands.

  • Each annual royalty payment (“Annual Royalty Payment”) shall equal 10% of Precept’s Gross Profit from the sale of Products under the Selected Brands during such Annual Royalty Period.
