The Owner of the Signage Area Unit or a Signboard Unit shall for as long as it remains the Owner of that Signage Area Unit or (as the case may be) Signboard Unit have the right at any time or times and from time to time as it shall deem fit to do all or any of the acts or deeds and to exercise all or any of the rights in Part E of this Schedule without the concurrence of any other Owner, the Manager, the Owners’ Corporation or any other person except expressly provided to the contrary therein.
Any Tenant sign permitted in the Lobby Signage Area shall be of a size comparable to other tenant signs in this area and the appearance, materials and method of installation shall all be approved by Landlord.
Shop, Parking Space, Open Area, Signboard Unit, the Signage Area Unit, the Common Areas and Facilities, the Development Common Areas and Facilities, the Residential Common Areas and Facilities, the Commercial Common Areas and Facilities, the Parking Common Areas and Facilities, the Signboard Common Areas and Facilities, the Development and the Land are references to each and every part thereof.
Company, at all times during this Agreement, shall have access seven (7) days a week, twenty-four (24) hours a day over the Premises in order to install, operate, maintain and repair the Signage located in the Signage Area by providing City with 24-hour email notice; provided, however, that such access shall not unreasonably interfere with the use of the Transit Facility by the City, its agents, invitees and the general public.
Notwithstanding the foregoing, in no event shall the Building Exterior Signage, at any time, prevent the other then tenant(s) of the Building (specifically excluding Tenant) from maintaining (i) at least one (1) identification sign, in the aggregate, located on the exterior of the Building, or (ii) exterior signage on at least fifty percent (50%) of the Permitted Signage Area (as that term is defined below) of the Building, in the aggregate.
Pinnacle may not erect or maintain any sign advertising the sale of portions of the Pinnacle Property or any other sign of a temporary nature on the Pinnacle Signage Area.
The City is not responsible to remove any snow that does stick to or pile on any signage letters in the Signage Area.
Further, if Tenant’s right to the dominant position in the Lobby Signage Area terminates due to Tenant’s failure to meet the Dominant Lobby Sign Location Conditions, Landlord shall not permit any other tenant, occupant or third party to install signage in such dominant position in the Lobby Signage Area unless such tenant, occupant or third party leases and is in occupancy of at least 155,300 rentable square feet of the Building and is the largest tenant of the Project.
In the event the whole of the City Property or Signage Area is taken by eminent domain, this Agreement shall terminate as of the date title to the City Property vests in the condemning authority.
The Signage Area is established by the Building’s architect and approved by Landlord on a building-by-building basis.
