Significant user definition

Significant user means a “significant industrial user” as defined in this section.
Significant user means any User of the District’s Sanitary Sewer whose flow exceeds 125 m3 per day (27,500 imperial gallons per day) or whose discharge to the sanitary sewer system typically has a strength of 500 mg/l S.S. or 500 mg/l B.O.D.
Significant user means any non-governmental, non-residential user of the publicly owned treatment facility which discharges more than the equivalent of twenty-five thousand (25,000) gallons per day of normal domestic sewage (excluding domestic wastes or discharges from sanitary conveniences; contributes a process waste stream which makes up five percent or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; is designated as such by the Village on the basis that the Industrial User has a reasonable potential for adversely affecting the POTW’s operation or for violating any Pretreatment Standard or Pretreatment Requirement(in accordance with 40 CRF 403.8(f)(6); all Industrial Users subject to Categorical Pretreatment Standards under 40 CRF 403.6 and 40 CFR Chapter 1, Subchapter N. Also included in this definition is any non- governmental user of the publicly owned treatment facility which discharges waste water to the treatment facility which contains toxic pollutants or poisonous solids, liquids or gases in sufficient quantity, either singly or by interaction with other waste, to contaminate the bio-solids of any municipal system or to injure or to interfere with any sewage treatment process or which constitutes a hazard to humans or animals, creates a public nuisance, or creates any hazard in or has an adverse effect on the waters receiving any discharge from the treatment facility.

Significant user means a User subject to Categorical Pretreatment Standards; or a User that (1) discharges an average of 25,000 gallons per day or more of Process Wastewater to the Racine Utility's Wastewater Treatment Facility (excluding segregated Domestic Sewage, noncontact cooling water and boiler blowdown wastewater); or (2) contributes a process waste stream which makes up five percent or more of the average dry weather hydraulic or organic capacity of the Wastewater Treatment Facility; or (3) has a reasonable potential for adversely affecting the Wastewater Treatment Facility or for violating any Pretreatment Standard or requirement.

Upon finding that an industrial user meeting these criteria has no reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, the city may at any time, on its own initiative or in response to a petition received from an industrial user, determine that such industrial user is not a significant industrial user.
