Applicant acknowledges that it has read, understands, and agrees to abide by all the terms set forth in Appendix A - "Standard Clauses for All New York State ▇▇▇▇▇▇▇▇▇▇ Site Cleanup Agreements" which is attached to and hereby made a part of this Agreement as if set forth fully herein.
All site rehabilitation shall be consistent with the cleanup criteria in §376.81, F.S., the requirements of Chapters 62‑780, F.A.C., Contaminated Site Cleanup Criteria, and 62-777, F.A.C., Contaminant Cleanup Target Levels; to allow access by the Department during the entire site rehabilitation process, as evidenced by the attached documentation (see Attachment C) incorporated herein, establishing that such site access has been secured by agreement with the real property owner.
The Grantee agrees to expeditiously provide, during the term of this Agreement, such reports, data, and information as may be reasonably required by the State Water Board, including, but not limited to, material necessary or appropriate for evaluation of the Orphan Site Cleanup Fund Program or to fulfill any reporting requirements of the federal government.
The sign shall include the following color logos: (logos available from the State Water Board) in accordance with the General Guidelines for Emblem and Logo Applications, Version 1.0 and the following disclosure statement: Funding for this project has been provided in full or in part by the American Recovery and Reinvestment Act of 2009 and the Orphan Site Cleanup Fund, through an agreement with the State Water Resources Control Board.
In addition, the quarterly meetings will: o Provide a forum to discuss sites of mutual interest; o Provide an opportunity to review and discuss Site Cleanup Plans for sites of mutual interest prior to public review; o Identify and share existing policy, procedure, and guidance documents; o Solicit timely input into developing policy and guidance; and o Develop opportunities for joint training of project and technical staff.
The following provision(s) authorize the State Water Board to enter into this type of Grant Agreement: Chapter 616, Statutes of 2008 established the Underground Storage Tank Petroleum Contamination Orphan Site Cleanup Fund (Orphan Site Cleanup Fund).
The State Water Board promulgated regulations to implement this program and they are contained in title 23 of the California Code of Regulations, chapter 18, article 7 (Orphan Site Cleanup Fund regulations).
At the time of dedication of the Port Property, the Port shall have completed a Site Cleanup such that the Port Property is Development Ready for a Park.
