  • This Settlement Agreement binds SK Shipping, and any principals, officers, receivers, trustees, successors and assignees, subsidiary and parent corporations and CARB and any successor agency that may have responsibility for and jurisdiction over the subject matter of this Settlement Agreement.

  • In consideration of full payment of the civil penalty, and all other undertakings above, CARB hereby releases SK Shipping and its principals, officers, receivers, trustees, successors and assignees, subsidiary and parent corporations, from any claims CARB may have based on the circumstances described in all paragraphs contained in the Case Background above.

  • SK Shipping shall pay the civil penalty by check, credit card, wire transfer, or portal, payable to the “California Air Resources Board,” using instructions provided separately by CARB in a Payment Transmittal Form.

  • SK Shipping shall make all payments within 30 calendar days from the date CARB notifies SK Shipping of the full execution of the Settlement Agreement.

  • At the time of payment, SK Shipping shall provide confirmation of payment being made, including the Payment Transmittal Form, to the email address in Paragraph 12 (Notices).

  • In order to resolve the violations described herein, SK Shipping has taken, or agrees to take, the actions enumerated below within the Terms and Conditions.

  • SK Shipping admits to the facts in paragraphs 1 through 6, but denies any liability resulting from said allegations.
