Software Extension definition

Software Extension means all components of the software made available to You by or on behalf of Xxxxxxxxx.Xxx pursuant to this Agreement intended to allow You to connect to and use certain Xxxxxxxxx.Xxx Services via one or more applicable third party applications, including but not limited to any associated object code, source code, code libraries, development or configuration tools, Documentation and any upgrades, modified versions, updates, and/or additions thereto, if any, made available to You by or on behalf of Xxxxxxxxx.Xxx pursuant to this Agreement.
Software Extension means all components of the software made available to You by or on behalf of Bank of America pursuant to this Agreement intended to enable You to connect to and use certain Bank of America Services via one or more applicable third party applications, including but not limited to any associated object code, source code, code libraries, development or configuration tools, Documentation and any upgrades, modified versions, updates, and/or additions thereto, if any, made available to You by or on behalf of Bank of America pursuant to this Agreement.

Examples of Software Extension in a sentence

  • Without limiting the generality of the foregoing, You shall not, and You shall require Your representatives not to, export, direct or transfer the Software Extension or the Documentation, or any direct product thereof, to any destination, person or entity restricted or prohibited by the Export Controls.

  • In the event You choose to submit any suggestions, feedback or other information or materials related to the Software Extension or Documentation or Your use thereof (collectively, “Feedback”) to Xxxxxxxxx.Xxx, You hereby grant to Xxxxxxxxx.Xxx a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual and irrevocable license to use and otherwise exploit such Feedback in connection with the Software Extension, Documentation, and other products and services.

  • You shall review the Documentation in order to determine which portions of the Software Extension are Open Source Software and are licensed under such Open Source Software license terms.

  • You hereby acknowledge that the Software Extension may contain software that is distributed under “open source” license terms (“Open Source Software”).

  • You acknowledge and agree that all right, title and interest in and to the Software Extension and Documentation shall, at all times, be and remain the exclusive property of Xxxxxxxxx.Xxx and that You do not have or acquire any rights, express or implied, in the Software Extension or Documentation except those rights expressly granted under this Agreement.

  • Xxxxxxxxx.Xxx has no obligation to provide support, maintenance, upgrades, modifications or new releases of the Software Extension.

  • If You (or any person or entity to whom you provide the Software Extension or Documentation) are an agency or instrumentality of the United States Government, the Software Extension and Documentation are “commercial computer software” and “commercial computer software documentation,” and pursuant to FAR 12.212 or DFARS 227.7202, and their successors, as applicable, use, reproduction and disclosure of the Software Extension and Documentation are governed by the terms of this Agreement.

  • When these changes are made, Xxxxxxxxx.Xxx will make a new version of the Agreement, Software Extension or Documentation available on the website where the Software Extension is available.

  • Upon termination of this Agreement, You shall cease all use of the Software Extension and the Documentation, return to Xxxxxxxxx.Xxx or destroy all copies of the Software Extension and Documentation and related materials in Your possession, and so certify to Xxxxxxxxx.Xxx.

  • In order to continually innovate and improve the Software Extension, You understand and agree that Xxxxxxxxx.Xxx may collect certain usage statistics including but not limited to a unique identifier, associated IP address, version number of the Software Extension, and information on which tools and/or services in the Software Extension are being used and how they are being used.

Related to Software Extension

  • Service Extension shall have the meaning set forth in Section 7.1(c).

  • Time Extension shall have the meaning set forth in Clause 10.5;

  • Contract Term Extension means an extension of the term of this contract, at the request of Purchaser, under this Subsection. This Subsection does not obligate Contracting Officer to grant Contract Term Extension.

  • Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.

  • Patent Term Extension means any term extensions, supplementary protection certificates and equivalents thereof offering Patent protection beyond the initial term with respect to any issued Patents.

  • Line Extension means the provision of facilities (including, but not limited to, poles, fixtures, wires, and appurtenances) necessary for delivering electrical energy from the point of origin to one or more of the customer's points of delivery. Facilities provided by the Company to maintain, protect, upgrade, or improve its overall distribution system (even if necessary due to a customer's load addition) are not considered part of a line extension.

  • Software Update means a release of Software, in object code form, or firmware, which provides minor fixes, improvements and modifications to the Software or Equipment. Kodak software releases that are designated as updates will be identified A.B.x where the x designates the release as a Software Update.

  • Software Updates means the Software releases, service packs, build updates or emergency fixes released from time to time in accordance with the Vocera’s update policy for such Software.

  • Statement of Work means the description of activities performed in completing the Project, as specified in the Contract and as may be amended.

  • Software License Agreement means the Motorola Software License Agreement (Exhibit A).

  • Collaboration Know-How means all Know-How conceived, discovered, developed or otherwise made by or on behalf of a particular Party or any of its Affiliates or permitted subcontractors of any of the foregoing (solely or jointly by or on behalf of a particular Party or any of its Affiliates or permitted subcontractors of any of the foregoing) in the course of [***].

  • Software License means a license for the Software granted under this XXXX to the Licensee;

  • Software Upgrade means a release of Software, in object code form, or firmware, which adds new functionality and feature enhancements to the Software or Equipment. Kodak software releases that are designated as Software Upgrade will be identified A.B.x where the A &B designates the release as a Software Upgrade.

  • License Key means a unique key-code that enables Licensee to run Software subject to the obtained User Pack.

  • Renewal Application means a document used to collect pertinent data for renewal of permits

  • Software Maintenance means the process of modifying software after delivery to correct faults, improve performance or other attributes, or adapt to a changed environment. (Reference ISO/IEC 14764:2006, as amended or superseded.) Software maintenance does not include any customization or configuration.

  • Development Schedule shall have the meaning set forth in Section 1.1.

  • Support and Maintenance Services means the support and maintenance services described in Section 1 of these Support Terms.

  • Support Service means an activity, such as information technology, accounting, human resources, legal, and other support functions that are required to support the ongoing delivery of core services.

  • Software licensing agreement means any agreement, regardless of how designated, that defines the intellectual property rights for, or the rights to use, any software product. A software licensing agreement must address only terms directly associated with licensing the right to use the software and must not address any of the work governed by the contract or any services (other than warranty services regarding the software code or associated documentation).

  • Computer software maintenance contract means a contract that obligates a seller of computer software to provide a customer with:

  • End User License Agreement means a license grant or end user license agreement governing software as further described in this Agreement or any applicable Appendix.

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Project Plan means the document to be developed by the Contractor and approved by WTL, based on the requirements of the Contract and the Preliminary Project Plan included in the Contractor’s bid. For the sake of clarity, the Agreed and Finalised Project Plan” refers to the version of the Project Plan submitted by the contractor after receiving the letter of Award and the same approved by WTL. The project plan may be changed/ modified during the course of the project. Should the Project Plan conflict with the provisions of the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Major modification means any physical change in or change in the method of operation of a major stationary source that would result in a significant emissions increase of a regulated NSR pollutant and a significant net emissions increase of that pollutant from the major stationary source.

  • Support Services means support in relation to the use of, and the identification and resolution of errors in, the Hosted Services, but shall not include the provision of training services;
