It is not known how many issuers will include community benefit expenditures or State premium tax liability in their MLR calculation, or how much community benefit expenditures will be included in the MLR calculation.
If the Investor elects to purchase annuities for all of the Participants, MassMutual will apply to the purchase of annuities the amount by which (i) exceeds (ii), where: (i) equals the Market Value of the General Account Assets; and (ii) equals the sum of: (I) administrative expenses applicable to the purchase of the annuities, and (II) any State premium tax liability due with respect to the purchase of the annuities.
