Subsection 6. 010 The Simi Valley Financing of the Credit Agreement is amended to read as follows: Simi Valley Financing shall fail to close on or prior to July 31, 1998, or shall close on or prior to July 31, 1998 but shall fail to generate net proceeds in an amount equal to or greater than Three Million Three Hundred Thousand Dollars ($3,300,000.00).

  • For purposes of this Section, the grievance procedure in Subsection 6 replaces the grievance procedure outlined in the local agreement.

  • The provisions of this Section shall be applied subject to the exceptions listed in Section D., Subsection 6., of this Article.

  • The salary schedule for teachers as defined in Section 15-38-1.02, Sub-section 6 of the N.D.C.C., shall be as set forth in Schedule I of the Appendix, which is hereby incorporated by reference.

  • Executive expressly waives any right to assert after signing this Agreement that any claim, demand, obligation, or cause of action has through ignorance, oversight, or for any other reason, been omitted from the scope of Subsection 6 of Section III of this Agreement.

  • Subsection means subsection of the section in which the term is used;

  • Section 3 means Section 3 of the Housing and Urban Development Act of 1968.

  • Subsections shall be to Sections and subsections, respectively, of this Agreement unless otherwise specifically provided.

  • Paragraph 3 No exchange teaching leave shall be granted for a period longer than one school year. The teacher receiving such a leave shall be entitled to all of the rights and benefits of employment he/she would have received had he/she performed his/her regularly contracted functions during the period of such leave. No such leave shall be granted until the questions as to which school district shall pay the salary and other employment obligations of such teacher have been resolved in a written agreement between the school districts concerned.
